온라인평판관리를 위한 효과적인 법률 글쓰기 방법론에 관한 연구

국문 초록

본 연구는 온라인상의 명예훼손, 모욕, 성범죄, 따돌림 등 사이버상의 권리침해로부터 구제를 받기 위하여 온라인평판에 악영향을 미치는 각종 정보를 삭제하기 위한 효과적인 법률 글쓰기의 기법을 제시하였다. 온라인 공간의 확대로 온라인평판을 잘 유지하고 관리하기 위한 관심과 노력이 필수적인 시대가 도래하였으며, 디지털장의사 내지 온라인평판관리를수행하는 전문적인 분야도 새로운 전문분야로 자리잡게 되었다. 온라인평판관리는 검색, 분석, 분류, 삭제 및 확산의 순환주기로 구성된다. 본 연구에서는 온라인평판관리의 순환주기중 삭제의 대상이 되는 정보를 대상으로 온라인평판관리에 있어서 삭제를 위한 법률글쓰기에 효과적인 “IRAC” 기법을제시하였다. IRAC기법이란 쟁점, 법률의 근거, 사실의 법률요건으로의 적용, 결론으로 이어지는 법률적인 문제파악에서관련되는 법률을 적용하고 이에 따른 결론을 도출하는 미국 로스쿨 및 법률계에서 사용되는 법률적인 문제해결 방안을도출하기 위한 기법이다. IRAC 기법은 또한 주어진 법률적인 상황을 이해하고 그 상황에 대한 해답을 구성하는 구조이기도 하다. 본 연구에서는 IRAC기법을 주어진 상황의 객관적 이해와 설득적 법률 글쓰기를 위한 방법론으로 제시한다. 이러한IRAC기법에 기반한 케이스 브리프 기법을 적용하여, 사이버상의 권리침해가 이루어지는 상황을 이해하고, 적용가능한 법률을 파악하고, 관련 법률의 성립요건으로 사실을 적용하여 분석한다. 결론에서는 삭제로서 사이버상의 권리를 침해한 정보의 게시중지 요청이 가능한지를 결정한다. 다음으로 IRAC기법에 기반한 항소 브리프 기법을 적용하여, 사이버상의 권리침해를 당한 당사자의 입장에서 권리침해에 관한 정보에 대하여 게시중지가 관련 사이트 및 기관으로 요청되는데, 이러한 요청은 설득적 글쓰기를 통해 기술된다. 따라서 이러한 IRAC기법은 온라인평판관리를 위한 사이버상의 권리침해로부터 구제하기 위한 효과적인 법률글쓰기의 방법론으로 이해할 수 있을 것이다.

영문 초록

The purpose of this study is to present an effective way of persuasive legal writing to delete the information that adversely affects online reputation in order to relieve from the violation of cyber rights such as online defamation, insults, sexual offenses and bullying. With the expansion of the online space, the era has come when the more interest and effort are essential in maintaining and managing online reputation, and digital undertakers and other professional fields performing online reputation management have also been established as a new specialized field. Online reputation management system consists of a cycle of search, analysis, classification, deletion and diffusion. In this study, IRAC method is proposed as an effective one of legal writing for the deletion of information that violates cyber rights in the cycle of online reputation management. The IRAC method is a legal problem-solving method used in law schools and legal circles in the U.S. IRAC stands for the Issue, Rule, Application and Conclusion in legal analysis. The IRAC method is also a framework for understanding a legal situation and organizing the answer to it. The IRAC method poses issues based on a given legal situation, and it applies given facts to the relevant laws and draws conclusions, identifying the solution to the legal problems. In this study, legal writing using the IRAC method is presented for the purpose of understanding a given situation objectively and enhancing to persuade the deletion of the violation of cyber rights in the given situation. By applying the case briefing method based on the IRAC method, the situation of violating cyber rights will be better understood, applicable laws will be better grasped, the elements of related laws are applied to the given facts and analyzed, and it will be decided whether the request for suspending the information online will be admitted. Next, by applying the appellate brief method based on the IRAC method, the suspension for uploading information online in violation of cyber rights will be requested in the position of applicants to the related sites or organizations, and this kind of request is based on the persuasive legal writing. Thus, this IRAC method can be understood as an effective way of legal writing to relieve the applicants from the violation of cyber rights for online reputation management.
