국문 초록

본 연구의 목적은 미국의 약물 법원과 일본의 다르크(DARC)를 중심으로 약물 정책의 변화, 내용, 평가를 살펴본 후 최근 급격하게 증가한 우리나라 마약류 사범의 문제와 이들의 재범방지를 위한 방안을제시하는 데 있다. 특히 마약류 범죄의 특성은 그 중독성과 의존성으로 인해 단약에 어려움을 겪으며, 그 결과 출소 후 사회에 복귀하더라도 높은 재범률을 보이고 있다. 미국의 경우 약물 법원을 설치하여마약류 사범의 재범률을 낮추고, 비용 절감의 효과를 보고 있으며, 일본의 경우 실제 약물 중독자들이설립하여 마약류 사범의 재범을 방지하기 위한 치료 시설인 다르크(DARC)를 운용하고 있다. 우리나라도 통합적이고 체계적인 관리 시스템 역할을 할 컨트롤 타워가 필요한데 약물 법원의 신설이 그 해결책이 될 것이다.

영문 초록

The purpose of this study is to examine the changes, contents, and evaluation of drug policies, focusing on the U.S. drug court and Japan's DARC and then to present the rapidly increasing problems of drug offenders in Korea and measures to prevent their recidivism. It is to present the problem of rapidly increasing drug offenders in Korea and measures to prevent their recidivism. In particular, the characteristics of drug crimes are difficult to quit due to their addiction and dependence, and as a result, they show a high recidivism rate even after returning to society after being released from prison. In the case of the United States, drug courts have been established to reduce the recidivism rate of drug offenders and reduce costs, Japan, DARC, a treatment facility established by actual drug addicts to prevent recidivism of drug offenders, is being operated. Korea also needs a control tower that will serve as an integrated and systematic management system, and the establishment of a drug court will be the solution.
