국문 초록

2020년 7월 15일자로 고위공직자범죄수사처의 설치 및 운영에 관한 법률이 시행되었지만 여·야의 정치적 대립으로 공수처장후보추천위원회의 구성이 늦어지는 등 공수처의 출범이 표류하고 있다. 그동안 막강한 검찰권력의 행사의 중립성과 공정성 문제에 대한 국민적 실망으로부터 어렵게 탄생한 공수처가 헌법적 근거가 부재하다는 전제하에서 위헌법률소송 또한 진행중이다. 일부에서는 검찰과 경찰이라는 형사사법기관이 있는데 별도의 수사기관을 만든다는 것은 행정과 예산낭비라고들 하지만 그간 검찰의 국회의원, 장·차관, 판·검사 등에 대한 수사에서 보여준 정치종속성을 생각해본다면 입법·사법·행정으로부터 독립된 수사기구가 필요함은 두말할 나위가 없다. 이에 본고에서는 공수처가 과연 헌법적 근거가 없어 위헌인지 여부를 검토해보고, 공수처의 필요성을 전제로 공수처가 더욱 중립적인 수사기관으로 자리매김하고 발전해 나갈 수 있도록 법 해석상의 쟁점을 분석하고 나름의 대안을 제시하였다.

영문 초록

On July 15, 2020, the law on the establishment and operation of high-ranking public officials’ criminal investigation office was enacted, but the launch of the investigation office is drifting because it can not form a nomination committee for the investigation chief due to the political confrontation between ruling party and opposition party. Unconstitutional legal proceedings are also underway under the premise that the investigation office, which has been difficult to find in the public disappointment about the neutrality and fairness of the exercise of powerful prosecution power, has no constitutional basis. Some say that it is administrative and budget waste to create a separate investigative agency, but considering the political adherence shown in the investigation of the prosecution’s lawmakers, ministers, vice ministers, judges, and prosecutors, there is no need to say that an independent investigative agency is needed from legislation, justice and administration. Therefore, this study examined whether the investigation office is unconstitutional because there is no constitutional basis, and analyzed the legal interpretation problems and suggested alternatives so that the investigation office can become a more neutral investigation agency on the premise of the necessity of the investigation office.
