시간강사 처우 개선을 위한 정책, 난제인가? 강사법시행까지의 주요 쟁점별 분석

국문 초록

본 논문은 오랜 진통을 거쳐 2019년 시행된 ‘강사법’을 우리 사회의 정책 난제 중 하나로 파악하여 법 시행 전후의 맥락과 쟁점을 분석하였다. 사회적 난제(wicked problem)의 학술적/실천적 의미와 주요 조건을 우선 살펴 관련 선행 이론을 정리한다. Rittel & Webber(1973)의 논문에 근거하여 볼 때, 강사법 논쟁은 우리 사회와 공공부문의 난제로 보기에 적정하다고 판단한다. 이어서 7년간 대학사회의 숨겨진 뇌관으로 4차례나 유예되어 오다가 최근에야 시행된 ‘강사법’ 이슈와 대응을 쟁점별로 논의한다. 주된 초점은 정책과정, 정책대상 집단의 참여, 이해관계자들의 입장, 정책결정자의 대응 방식 등이 될 것이다. 기본적으로 2011년 이래 이 법의 기본취지는 대학 시간강사들의 위상과 처우개선이었는데, 그 목적을 이루었는지 의문이 제기된다. 세부 목표와 정책수단의 추상성, 대상집단과의 충분한 소통 부족과 정책수립을 위한 정보부족 등으로 법 시행 후에도 어려움이 이어지고 있다. 이는 공론화된 문제를 즉각 해결하려는 의도의 하향식 정책 수립, 예산 등 자원확보의 미흡, 대학 현장의 목소리 미반영 등이 복합 작용하여 지금까지도 어려움이 이어지는 것으로 보인다. 오랜 난제에 대한 뚜렷한 대안을 쉽게 찾기 어렵지만, 이해집단 간 협력적 접근이 최선의 방향이 될 것이다.

영문 초록

This paper examines the process and key points of Korea’s 2019 Revision of the Higher Education Act, a.k.a. ‘Lecturers Act,’ from a viewpoint of socially ‘wicked problems.’ Upon reviewing the theoretical meaning and the features of ‘wicked problem,’ particularly based on the well-known Rittel & Webber(1973) article, we review relevant theories and cases at the outset. The controversies on the Lecturers Act, a typical example of wicked problem which had been suspended for seven years due to its own complexities and controversies, is analyzed through its agenda-setting, public decision making, suspension and implementation. Emphasis shall be put on the causes and goals of the Act, participation of the stake-holders, their diverse positions, etc. Although the legislation since 2011 clearly stated that its purpose is to improve the status and rewards for part-time university instructors, it does not appear that the overall process have fared well. The key issues include: unclear formation of the issues, mimatch of policy goals-means, lack of efficient communication with target groups/participants, etc. There seems to be no cure-all for this wicked problem. We suggest that, based on complete awareness and knowledge of the issues in question, there should be more efforts in enlarging networked, collaborative approach instead of a hasty, top-down one when addressing this nature of tough issues.
