국문 초록

법학전문대학원에서 경쟁법 교육은 변호사시험 준비에 바쁜 학생들을 상대로 선택과목을 교육하여야 하는 한계에서 출발한다. 법 전체를 관통하는 프레임이 있고 이를 이해할 수 있다면 도움이 될 것인데, 경쟁법에서는 시장과규제라는 프레임이 그러한 역할을 한다. 이는 경쟁법적 도구일 뿐 아니라 규제와 관련된 일반 사건에도 그대로 적용될 수 있다. 개별 판례들을 검토해서 시장적 관점과 규제적 관점이 대립하는 논란들을 쉽게 이해하는데 도움이되는 도구를 제시함으로써 나름의 시각으로 사건을 바라볼 수 있는 경험을 전하는 것은 프레임의 효율성을 느끼게해 줄 수 있다. 경쟁법적 규제 여부를 결정하는 규범적 성립요건 해석에 관한 판례도 시장에 맡길 것인가, 국가가개입할 것인가와 관련된 많은 논의 끝에 정립된 것이다. 민사법, 형사법 등의 기본법이론이 경쟁법상 합의, 담합의탈퇴 등의 이론에 영향을 준 점을 인식시켜서 효율적 이해를 도모할 수 있다. 또 경쟁법 판례의 사실관계 학습을통하여 시장 관련 기본지식과 사회전반의 이해를 얻을 수 있는 기회로 삼을 수 있다.

영문 초록

The education of competition law in Korea law school has precondition and limit where most students devote themselves to study for the bar exam. Competition law is not required subject but just elective subject. If you could find and understand the frame which go through the concrete law, you would easily be encouraged to study the law. In competition law the moto of market or reulation? has the role. It is the basic rule in the market-capitalism society for the market to divide and rule the sources and goods. To make competitional market-regulation, the situations have to be satisfied with the conditions in competition law. This market or regulation frame can be the good utility to explain other cases which has the regulation issue, not just in competition law. In the competition law precedents market or regulation has been the captial issue to decide where to stand. The basic legal theory in the civil law and penal law has influenced on the cartel establishment and breakaway from the cartel. To point this relevance can make them to understand easily. Also the case study can give the chance of understanding the basic knowledge in the market and issues in the society.
