국문 초록

본 연구는 최근 시행된 ｢국가경찰과 자치경찰의 조직 및 운영에 관한 법률｣에 관한 것으로 개정안과 시행법률의 비교를 통해 일원적 모델인 한국형 자치경찰제에 대한 법적 검토 및 문제점에 대한 고찰을 목적으로 한다. 경찰법이 2021년 1월부터 ｢국가경찰과 자치경찰의 조직 및 운영에 관한 법률｣로 전면개정 및 시행됨에 따라 일원적 자치경찰제가 도입되었다. 코로나19에 따른 예산문제로 본래의 이원적 자치경찰제를 대체하는 일원적 자치경찰제는 경찰조직은 기존과 같이 유지하되, 경찰사무를 국가경찰사무, 수사경찰사무, 자치경찰사무로 구분하고, 각 사무를 국가경찰위원회, 국가수사본부, 시도자치경찰위원회가 지휘 및 감독하는 것을 골자로 하고 있다. 이원화 모델에서 시급하게 일원화 모델로 바뀌어 발의된 후, 유관기관들은 개정안에 대한 해석의 차이와 상이한 요구사항이 드러났다. 발의 이후 개최된 국회 토론회에서는 경찰청과 시도지사협의회, 학계 그리고 직장대표협의회에서 각자의 입장에서 논의하였고, 시행법률에 일부 반영되었다. 시행법률은 자치분권적 측면에서 미흡한 점이 많고, 자치경찰제의 요소가 명확히 드러나지 않는다. 이에 경찰사무분장의 유연성 강화, 수사심의위원회 설치 등 법적 제도적 개선방안을 제시하였다.

영문 초록

In this study, I will examine the legal issues and problems of the autonomous police system, comparing amendments and enforcement of the law in The Act on Organizational System of National Police and Autonomous Police (General Revision of Police Act). Since January 2021, the initary autonomous police system has been implemented, and the Police Act has been enforced by general revision. The initary autonomous police system that substitutes a dualistic system requires that the organization of police is maintained and their business is divided into national business, autonomous business, and investigation, commanded and supervised by the National Police Committee, Autonomous Police Committee, and National Office of Investigation. National Police Agency and Governors Association of Korea have differently interpreted the general revision of the Police Act and each requirement following the bill proposal for the change from a dualistic to a unitary autonomous police system. Subsequently, the NPO, the GAOK, police and the Police Labor Union have discussed these issues at the Conference at National Assembly, and its contents is reflected in the enforced Police Act. Enforcement of the Police Act is inadequate for municipal control and does not demonstrate the characteristics of autonomy. Therefore, I present a legal and institutional improvement plan that includes reinforcing police resource distribution and an Investigation Deliberation Commission.
