국가수사본부 도입을 위한 경찰법 개정안의 조문별 함의와 문제점에 관한 연구

국문 초록

문재인 정부 들어 공약사항으로 내걸었던 권력기관의 개혁이 속도를 내고 있다. 얼마전 검찰과경찰의 수사권 조정이 이루어졌고, 고위공직자범죄수사처의 설치와 운영에 관한 법률이 제정 및시행되었다. 국가수사본부의 도입으로 비대해진 경찰권한을 분산하고, 경찰 수사의 전문성과 중립성을 확보하기 위한 노력도 한창 진행중이다. 관련 법안이 2020년 말에 통과되었다. 이러한시점에서 한국 경찰은 변화하는 수사 환경에 재빠르게 발 맞추어 국민이 요구하는 수사시스템을제대로 정착시켜야 하는 과제에 직면해 있다. 이러한 목적을 달성하기 위해 본 연구에서는 국가수사본부의 원래의 도입 취지를 올바로 살리기 위해서 필요한 관련 법안의 조항들의 함의와 문제점을 국회 회의록과 학술자료, 랜선 자료의 수집 등을 통해 살펴보았다. 무엇보다 중요한 것은 국가수사본부장의 중립성 확보인데 이러한 맥락에서 경찰청장의 구체적인 사건지휘 규정은 삭제되어야 할 것이다. 마찬가지로 시· 도 경찰청장과 경찰서장의 소속 수사부서의 장에 대한 구체적 사건지휘 역시 금지하여야 할 것이다. 그리고 국가수사본부라는 조직을 실효적으로 운영하기 위해서국가수사본부장에게 인사권과 감찰권을 부여하여야 할 것이다.

영문 초록

The reform of the power institutions that Moon Jae-in government has made as a pledge is accelerating. Not long ago, the prosecution and the police were adjusted for investigation rights, and laws on the establishment and operation of high-ranking public officials’ criminal investigation offices were enacted and enforced. The introduction of the National Investigation Headquarters is also in the midst of efforts to disperse the bloated police authority and secure the expertise and neutrality of police investigations. The bill was passed at the end of 2020 and at this point, we face the task of establishing the investigation system that the public demands in line with the changing investigation environment quickly. To achieve this purpose, this study examined the implications and problems of the relevant legislations necessary to properly utilize the original purpose of the National Investigation Headquarters through the minutes of the National Assembly, academic materials, and the collection of the LANS. The most important thing is to secure the neutrality of the head of the National Investigation Division. In this context, the specific case command regulations of the police chief should be deleted. Likewise, it is necessary to prohibit the specific case command for the head of the investigation department of the police chief and the police chief of the city and province. In order to effectively operate the organization called the National Investigation Headquarters, the head of the National Investigation Headquarters should be given personnel rights and inspection rights.
