보육교직원 권리보호를 위한 ‘보육사업’ 개선방안 연구

국문 초록

목적 본 연구는 보육교직원의 권리보호 근로환경을 확보함으로써 보육의 질을 높이고자 하였다. 방법 이를 위하여 각종 문헌연구 조사를 통해 교육권, 근로권, 복지권으로 권리지표를 고안하고, 보육교직원의 근로환경과 일치할 수 있도록 보육사업과 영유아보육법 등을 검토하였다. 결과 보육사업 지침 분석을 통해서 보육교직원들의 전문성 교육 불인정, 자격기준 체계의 모호성, 근로환경 불안정, 실제 근로환경과 일치하지 않는 무리한 법령준수 등의 요구하고 있음을 확인하였다. 결론 보육교직원 권리보호를 위한 해결방안은 첫째, 영유아보육법 제8조2항 ‘보수교육 관리’ 내용을 삽입함으로써 교육권을 확보토록 하였다. 둘째, 보육사업안내에 자격취득 급수에 따라 호봉획정이 될 수 있도록 보수체계를 정비하였고, 영유아보육법 제4조(책임) 4항에 ‘보육교직원의 지위 향상 및 보육활동 보호를 위한 조치를 취해야 한다.’를 삽입할 것을 요구함으로써 우발적 사고에 대응하는 보육교직원의 근로권을 확보하였다. 셋째, 보육교직원의 안정된 근로환경을 제공하기 위해 구체적 지원체계를 제시함으로써 근로권을 확보하였다. 넷째, 영유아보육법 제17조(보육교직원의 배치)3항의 내용을 ‘전일제 보조교사를 둔다’로 변경하고, 5항에 ‘연장반 구성별로 교사를 지원’하도록 신설함으로써 복지권을 확보하였다.

영문 초록

Objectives This study aims to improve the quality of childcare by securing a working environment for the protection of rights of childcare teachers. Methods To this end, various literature research surveys were conducted to devise rights indicators for education, working rights, and welfare rights, and to review childcare projects and infant care act to match the working environment of childcare staff. Results The guidelines for childcare projects were analyzed to confirm the beauty of professional education of childcare staff, ambiguity in the qualification standard system, instability in the working environment, and compliance with laws that do not match the actual working environment. Conclusions First, the solution for protecting the rights of childcare teachers and staff was to secure the right to education by inserting the contents of Article 8 (2) of the Infant Care Act. Second, the maintenance system was reorganized so that the salary can be revised according to the number of qualifications in the childcare project plan. and It secured the right to work for childcare staff in response to accidental accidents by requesting that Article 4(Responsibility) 4(4) of the Infant Care Act insert “measures shall be taken to improve the status of childcare staff and protect childcare activities.” Third, the right to work was secured by presenting specific support systems to provide a stable working environment for childcare staff. Fourth, the welfare rights were secured by changing the contents of Article 17 (Arrangement of Child Care Teachers) (3) of the Infant Care Act to “Put Full-Time Assistance Teachers” and establishing “Support Teachers by Extension Team” in paragraph 5.
