학교예술강사의 고용 및 처우에 관한 판례평석의 법리적 해석과 개선방안 모색

국문 초록

목적 이 연구는 학교문화예술교육의 활성화를 이끌어온 교육부와 문화체육관광부의 부처간 협력사업, ‘학교예술강사 지원사업’의 이해관계자인 예술강사의 고용 안정과 처우 개선과 관련된 판례평석을 법리적으로 해석하고 개선방안을 제시하는 것을 목적으로 하였다. 방법 2021년 6월부터 9월까지 전형적 사례선택을 통해 현직 변호사, 문화예술계 자문 법조인 등의 전문가 12명과 예술강사 지원사업 실무자 10명을 전문가집단으로 설정하고 개방형 설문조사와 AHP조사를 실시하여 예술강사의 고용 관련 판례평석을 법리적으로 해석한 후 정책적, 제도적 개선방안을 제시하였다. 결과 첫째, 학교예술강사의 고용에 관련된 판례평석 유형은 예술강사의 근로자성 인정과 고용 주체의 일원화, 예술인복지법에 근거한 계약관계 및 복리후생, 청년 비율 기준의 유연화를 통한 재정지원 일자리 사업의 유지, 신규강사와 경력강사의 공존을 위한 지원사업의 이원화의 네 가지로 도출되었다. 둘째, 판례평석의 법리적 해석을 통해 예술강사의 근로자성을 확인할 수 있었으며, 예술인의 권익 보호와 복지 개선, 청년 비율의 하향 조정과 이원화 운영이 제기되었다. 셋째, 학교예술강사 고용 및 처우 사안의 중요도는 ‘청년 비율 기준의 유연화를 통한 재정지원 일자리 사업의 유지’(0.329), ‘신규강사와 경력강사의 공존을 위한 지원사업의 이원화’(0.319), ‘예술강사의 근로자성 인정과 고용 주체의 일원화’(0.254), ‘예술인복지법에 근거한 계약관계 및 복리후생’(0.098)의 순으로 나타났다(CI=0.80). 결론 학교예술강사의 고용 및 처우에 관한 법리적 해석과 설문조사 결과를 바탕으로 예술강사의 ‘근로자성’에 대한 인정, 청년 신규강사와 경력강사의 문화예술 분야 경력 및 진로 개발, 고용기회를 누릴 수 있는 방안을 제안하였다.

영문 초록

Objectives The purpose of this study was to legally interpret the review of precedents related to job security and treatment improvement of art instructors, stakeholders of the Ministry of Education and the Ministry of Culture, Sports and Tourism, which have led to the revitalization of school arts and culture education. Methods From June to September 2021, 12 experts, including incumbent lawyers and advisory legal professionals in the arts and culture, and 10 art instructor project workers were set up as expert groups, open surveys and AHP surveys were conducted to legally interpret the employment-related precedents and suggest policy and institutional improvement measures. Results As a result of the study, firstly, there were four types of review related to the employment of school art instructors: worker performance and employment subject of art instructor, contractual relationship and welfare of art instructor, maintenance of financial support job project, and coexistence of new instructor and career instructor. Secondly, the legal interpretation of the case review confirmed the worker nature of art instructors, and the protection of artists rights and interests, improvement of welfare, downward revision of the youth ratio, and dualization operation were raised. Lastly, the importance of hiring and treating school art instructors was in the order of “maintenance of financial support job projects through flexibility of youth ratio” (0.329), “division of support projects for coexistence of new and career instructors” (0.254), and “contract relations and welfare based on the Artist Welfare Act” (0.98)(CI=0.80). Conclusions Based on the results of the legal interpretation and survey on the employment and treatment of school art instructors, it was proposed to recognize the worker nature of art instructors, to enjoy career and career development and employment opportunities in the field of culture and arts.
