국문 초록

현대사회에서 부동산의 역할은 점점 커지고 중요해지고 있다. 부동산 활동은 매매, 교환, 이용, 평가, 개발 등의 경제적, 법률적 활동을 통해 이뤄지고 있으며, 궁극적인 목적은 부동산 이용을 통한 가치창출의 극대화에 있다. 이러한 모든 부동산 활동에는 대상 부동산의 경제가치가 얼마인지 최종판단에 도달하여, 이것을 화폐액으로 표시하는 감정평가를 반드시 필요로 한다. 특히 요즘과 같은 부동산공시가격의 적정성 논란과 부실평가에 따른 사회적 피해가 증가하고 있는 상황에서 필수적으로 논의되어져야 하는 것이 감정평가업자의 전문성과 직업윤리의식 그리고 신의성실에 입각한 신중함이다. 또한 감정평가업무는 사회경제적으로 중요성이 매우 크기에 높은 윤리의식이 선행되어야 하며, 전문성과 투명성, 중립성이 요구된다. 그럼에도 불구하고, 실제에선 여러 가지의 감정평가 분쟁에 의한 소송이 발생하고 있으며 사례가 줄어들지 않고 있다. 따라서 본 연구는 감정평가업자에게 부여되는 부동산감정평가의 소송실태와 행정적 제재를 분석하여 이의 개선방안을 도출하여 감정평가업자 관련 소송을 줄일 수 있는 기술적, 윤리적 방안을 마련하였다.

영문 초록

The role of real estate in modern society is getting bigger and more important. Real estate activities are carried out through economic and legal activities such as sales, exchange, use, evaluation, and development, and the ultimate goal is to maximize value creation through real estate use. All these real estate activities require an appraisal that reaches the final judgment on the economic value of the target real estate and displays it as money. There has been an increase in the social damage caused by controversy over the appropriateness of real estate disclosure prices and the evaluation of insolvency. In particular, what is essential to be discussed is the expertise and professional ethics of appraisers. While the valuation appraisal work should be preceded by a high ethical awareness that is of great social and economic importance, various disputes of appraisal evaluation are actually continuing and requires professionalism and transparency neutrality. Nevertheless, in reality, lawsuits due to various appraisal disputes are occurring and cases are not decreasing. Therefore, this study analyzed the actual condition of the real estate appraisal and administrative sanctions given to the appraisers and drew up the improvement plan for the appraisal appraisers and prepared technical and ethical measures to reduce the lawsuits related to the appraisers
