국문 초록

이 연구는 민간조사제도에 대한 쟁점사항에 대하여 살펴보고 이에 대한 대응 방안을 제시하기 위한 연구로서 연구의 완성을 위하여 민간조사제도에 대한 쟁점 사항을 바탕으로 문제점을 파악하고 개선방안을 제시하였다. 민간조사제도는 민간차원에서 수사와 같이 사후적인 치안서비스를 제공하는 활동으로서, 경찰이 독점하였던 사후적인 대응을 민간인이 치안서비스를 제공하는 활동이다. 기존의 민간의 치안서비스 제공은 민간경비가 전부였으나, 최근들어 민간조사에 대한 수요가 증가함에 따라 우리나라에서도 이 제도를 합법화하기 위한 노력을 하고 있다. 아직 합법화되지 않은 탓에 그 필요성을 인정하고 있으나, 민간조사제도의 취약한 문제점인 사생활 침해와 같은 국민의 기본권 침해 가능성과 변호사와 수사기관의 영역을 침입할 수 있다는 의견, 그리고 정보가 편중될 수 있다는 의견으로 인하여 약 20여년간 법안이 통과되지 않고 있다. 현재 민간조사제도 도입과 관련하여 많은 쟁점들이 다뤄지고 있다. 첫 번째로, 민간조사제도의 도입에서 위와 같은 사안들을 함께 이루어가며 노력한다면 우리나라에서 민간조사제도는 빠르게 자리를 잡을 것이고 시행 초기의 부작용들 또한 많이 해소될 수 있을 것이다.

영문 초록

The purpose of this study is to examine the issues regarding the private investigation system and to suggest response measures. To complete the research, this study identified the problems based on issues regarding the private investigation system and suggested improvement measures. Private investigation system is an activity that provides a follow-up public peace service in the private level. While the police was exclusive in charge of follow-up measures, private investigation system allows public peach service in the private level. While the private-level public peace service was only limited to private security, there is increasing demand on private investigation and the Korean government is making efforts to legalize this system. While the need for private investigation system is acknowledged, the bill related to private investigation system hasn’t been passed for about 20 years due to risks on infringement of fundamental rights such as invasion of privacy, invasion on areas of attorney and investigative agencies, and concentration of information. Currently, numerous issues regarding the introduction of private investigation system are covered. First, the private investigation system will settle down in Korea quickly and side effects during initial introduction stage will be relieved by making efforts together and handling the above matters in introducing the private investigation system.
