국문 초록

이 연구는 미술교과에서 지적재산권에 대한 교육의 필요성의 고찰하는 연구이다. 현대 미술은 전통적인 미술 기법과 달리, 다양한 장르와 표현 방식으로 기계나 매체 의 사용까지도 포함하게 되었고 예술가가 직접 제작하기 어려운 기술적인 요소들의 위탁은 대작과 순수 표현의 구분을 어렵게 하기에 충분했다. 현대 미술에서 창작성의 변화는 미술 표현과 관련한 지적재산권(intellectual property right)의 보호 범위가 어디까지인가에 관한 논의를 불러일으키게 한다. 또한 정보화 시대에 다양한 매체를 활용하고 있는 학습자들이 현대 미술의 표현 방식, 혹은 창작의 순수성과 같은 논의를 올바로 이해하기 위해서는 지적재산권과 저작권 (copyright)에 관한 교육이 시급하다. 본 연구는 미술에서 저작재산권(economic right)과 저작인격권(moral right)의 개념을 살펴보고, 이러한 종류의 지적재산권이 미술교과에서 어떠한 내용으로 다루어져야 하는지를 고찰하였다. 미술교과에서 지적재산권 관련 영역은 표현 기법의 사용과 차용, 올바른 도판의 활용 범위, 미술가의 권리에 대한 이해, 미술작품의 소유와 판매에 대한 이해 등의 내용에서 다루어질 수 있다. 미술교과가 지적재산권과 관련한 영역을 다루어야 하는 이유는 학습자들이 현대 미술 표현을 이해하고 향유하는 데에 가치 판단의 근거를 제공하고, 미술 문화와 미술교과를 더욱 풍요롭게 하고, 바른 길로 나아갈 수 있도록 돕는 방법이기 때문이다.

영문 초록

Modern art has continued through pop art, conceptual art, and parody to pursue diverse genres and representation methods instead of traditional art representation methods. Unlike traditional art techniques, the novelty of the representation method and the creativity of ideas are regarded as the key elements of art representations. The diverse genres and representation methods of modern art have included even the use of machines and media, and the relegation of the technical factors that are difficult for the artists to produce in person has been enough to make it difficult to distinguish between substitute and pure representations. Such confusion of modern art raises discussions as to the scope of the protection of property rights or representations related to art representations. Also, in order for the learners to understand such discussions as the representation methods of modern art or the purity of creations, researches and education on these matters are urgently needed. So where the copyright of art representations was examined in this research and, along with the legal disputes regarding this, the concepts of artists’ economic rights and artists’ moral rights were examined. Also, how the intellectual property rights should be dealt with in the art class was examined. The reason that the areas related to intellectual property rights should be dealt with in the art class is because it provides the grounds for value judgment for the learners to understand and enjoy modern art representations. And by extension, this is also the way to help us enrich our art and the art class and make progress in the right direction.
