국문 초록

이 연구는 학교폭력대책자치위원회 운영의 문제점을 밝히고 그 개선방안을 탐색하는 것을 목적으로 하였다. 연구방법은 문헌연구와 핵심집단인터뷰(FGI, Focus Group Interview) 방식을 병행하였다. 문헌연구로서 자치위원회의 법제적 측면과 성공적인 집행 요인, 핵심 가치로서 회복적 정의의 관점을 탐색한 후, 이를 기반으로 FGI를 실시하였다. FGI는 서울소재 강남ㆍ강북지역의 중학교, 고등학교 각 1개교를 선정하고, 교감, 학교폭력업무담당 교사 등을 핵심집단(FG)으로, 자치위원회 외부위원 등을 참고 집단(CG)으로 활용하여 2017년 8월부터 2018년 1월까지 6개월간 진행하였다. 주요 문제점으로는, 학교폭력 개념의 모호, 전학 및 퇴학처분의 효과 미흡, 자치위원회의 업무과중과 법적 갈등 빈발, 자치위원회의 의무적 개최에 따른 비효율성, 전문가 위원 구성애로 등이다. 개선방안으로는, 학교폭력 개념과 대상행위의 시·공간적 범위의 명료화, 학교폭력 행위의 경중에 따라 형사법체계와 학교폭력예방법체계로 이원화, 학교폭력전담 전문기구의 학교 밖 설치, 전학 및 퇴학조치를 장기 출석정지 조치로 변경, 교육청 및 지자체 차원의 전문가 인력풀 구성 및 지원 등을 제시하였다.

영문 초록

The purpose of this study was to explore operational pronlems and improvement plan of the school violence measures autonomy committee, which is the key enforcement body of school violence prevention policy. The research methods were combined with literature review and focus group interview (FGI). In the literature review, this study searched for legal aspects of autonomy committee, successful execution factors, and restorative justice as core values of autonomy committee management. Based on this, FGI was implemented. For FGI, this study selected one school in each of junior-high and high schools in Gangnam and Gangbuk areas in Seoul, and employed school vice principals, and teachers in charge of school violence as a focus group (FG) using the autonomy committee as a comparative group (CG) for six months from August 2017 to January 2018. The problems and improvement measures are raised as follows: the concept of school violence and clarification of temporal and spatial scope of object behavior, dualization of its application to criminal system and school violence prevention system according to the severity of school violence and sexual violence, establishment of a dedicated professional body outside the school and establishment of an organic linkage system with the school-dedicated body, change from transfer and expulsion to long-term suspension of attendance, the establishment and support of a pool of specialized HR personnel at the dimension of the office of education and local government body, granting educational discretion in the case of minor issues, supporting community professionals and infrastructure to improve prevention education, etc. To improve the effectiveness of the school violence prevention policy, it is necessary to comprehensively improve the policy and related legal system including these issues and improvement measures.
