국문 초록

국민의 선거권은 헌법의 보통, 평등, 직접, 비밀선거의 원칙 아래서 법률에 의해 구체화된 보장을 받는다. 선거권은 헌법상 정치적 표현의 자유로 보장받을 수도 있다. 그러나 우리 공직선거법 규정은 선거운동에 관하여 폭넓게 제한규정을 두고 있다. 따라서 UCC, Twitter와 같이 인터넷을 이용한 새로운 매체를 이용한 선거운동도 일정한 범위에서 제한하게 된다. Condorcet의 배심정리(Condorcet's jury theorem)에 따르면 수학적으로 올바른 선택을 할 수 있는 개연성 혹은 능력을 50% 이상 가진 투표자 집단이 다수가 될수록 그 집단의 판단은 올바른 선택이 될 개연성이 높아진다. 따라서 우리는 선거운동을 통하여 유권자들이 올바른 판단을 할 수 있는 능력을 50% 이상 높이기 위하여, 충분한 정보를 제공하고 숙고할 기회를 제공해야 한다. 그리고 올바른 판단을 할 수 있는 유권자들이 보다 다수가 투표에 참가하도록 유도해야 한다. 이를 위해서는 UCC, Twitter 등의 새로운 미디어가 유권자들의 선거참여와 올바른 판단을 위해 기여하기를 기대한다. 하지만, 인터넷 선거운동이 긍정적인 면만 있는 것이 아니라, 집단의식을 극단적인 소수로 분극화(polarization)하는 문제가 발생할 수 있다. 선거라는 특수한 상황에 인터넷 선거운동이 모욕, 비방, 허위사실의 유포로 인한 선거 공정성 침해도 우려할 수 있다. 또한 공공재인 인터넷에 허위사실이 다량으로 유포되는 것도 우리 모두에게 옳지 않다. 따라서 입법적으로 인터넷 선거운동이 가능한 영역을 넓히면서도 이로 인하여 민주주의에 부정적인 영향이 발생하지 않도록 하는 정책을 실현하도록 구상해야 할 것이다.

영문 초록

People's suffrages usually guarantees the security that is the principle of equal and secret, direct election by the law and the constitution. The suffrage can be preserved by a political free expression in the constitution. However, The Korea Public Office Election Law widely put restrictive regulations for the election campaign. Therefore, there is the heavy limitation in the election campaign using a new medium using the Internet as UCC and Twitter. According to Condorcet's jury theorem , The voter group with the possibility or ability, that can mathematically select correct choice over 50% or more, maybe make a correct selection to the judgment of the group as much as possible. Therefore, we should offer the chance for voters to consider enough information through the election campaign. and voters may improve the ability that a correct judgment can be done by 50% or more. And, the more voters make correct judgment should participate in election. For this, new media such as UCC and Twitter are expected to contribute for the voters' election participation and correct judgments. However, there is no positive aspect in it. The Internet election campaign is generated and the problem of polarization can generate extreme small number of group consciousness. sometimes Internet election campaign can interrupt fair election by the insulting, slander, false fact about a special situation on interest. Moreover, because the Internet is "Goods of Public", it doesn't correct spreading large amount of the false fact on it. In legislation, the Internet election campaign area should be expanded, therefore, it should not get negative influence and develop make fair democratic way.
