자치법규 사전입법영향분석 사례연구

국문 초록

지방분권법 제27조부터 제29주까지의 위임에 의하여 지방자치단체는 조례로 읍·면·동의 주민자치회의 구성 등에 관하여 규정하고 있다. 현재 우리나라에는 현재 260개 시·군·구에 3,501개의 읍·면·동이 있으며, 이 중에서 약 136개 시·군·구 1,013개 읍·면·동에서 주민자치회 시범실시 중이다. 우리나라에서는 1999년에 주민자치위원회가 도입되어 운영되고 있었다. 그러나 주민자치위원회의 문제점을 보완하고 역할과 기능을 확대하기 위하여 2010년에 지방행정체제 개편에 관한 특별법을 제정하여 임의기구로서 주민자치회를 두었다. 그리고 행정안전부는 2013년부터 시범실시지역 31곳을 선정하였으며, 그해 6월 20일에 “주민자치회 시범실시 및 설치·운영에 관한 조례 개정(안)”을 마련하여, 지방자치단체를 지원하고 있다. 그리고 주민자치회의 기능과 권한을 강화하고, 주민자치위원의 대표성을 제고하였으며, 행정적·재정적 지원을 강화하는 등 주민자치회의 활성화를 위하여 노력하였다. 행정안전부는 주민자치회 표준조례안을 제공하는 방식으로 지방자치단체를 지원하고 있으며, 각 지방자치단체는 표준조례안을 자신의 지역에 맞도록 적절히 수정하여 사용하고 있다. 2022년 9월 현재 171개 시·군·구에서 주민자치회 설치 등에 관한 조례를 제정하고 있으며, 43개 시·군·구에서 조례의 시행규칙을 제정하여 운영하고 있다. 그러나 대부분의 지방자치단체들은 행정안전부의 표준조례를 참고하여 지역실정에 맞게 수정하여 제정하여야 함에도 불구하고, 많은 표준조례에서 발견되는 문제점과 같이, 주민자치회에 관한 조례도 무비판적으로 표준조례의 문구들을 그대로 반영하여 사용하고 있다. 대부분의 시·군·구에서는 그동안 주민자치위원회로 운영하거나, 주민자치회로 전환을 하였다고 하더라도 시범실시에 머물러 있는 상황이며, 최근에 주민자치회의 전면실기 다수의 시·군·구로 확산되고 있다. 전면실시로 나아가면서 동시에 주민자치회 관련 조례를 제·개정하고 있기에, 행정안전부에서 제공하는 주민자치회 표준조례에 대한 사전입법영향분석을 하여, 각 지방자치단체가 주민자치회 조례를 제·개정하는데 참고자료가 될 수 있도록 하여야겠다.

영문 초록

In accordance with the delegation from Articles 27 to 29 of the Decentralization Act, local governments stipulate by ordinance on the composition of local residents' associations in Eup, Myeon and Dong. Currently, in Korea, there are 3,501 Eup-Myeon-Dongs in 260 Si-Gun-Gu, of which, about 136 Si-Gun-Gu 1,013 Eup-Myeon-Dongs are conducting a pilot trial. In Korea, the Residents' Autonomy Committee was introduced and operated in 1999. However, in 2010, the Special Act on Reorganization of Local Administrative Systems was enacted to supplement the problems of the Residents' Autonomy Committee and to expand its roles and functions, and the Residents' Association was established as an voluntary organization. In addition, the Ministry of Public Administration and Security has selected 31 pilot regions since 2013, and on June 20 of that year, “Revision (draft) of Ordinances on Demonstration Implementation, Installation and Operation of Residents’ Associations” was provided to support local governments. In addition, efforts were made to revitalize the residents' association by strengthening the functions and authority of the residents' autonomous association, enhancing the representativeness of the residents' autonomous committee, and strengthening administrative and financial support. The Ministry of Public Administration and Security supports local governments by providing the standard ordinance draft for the residents' associations, and each local government is using the standard ordinance draft by appropriately modifying it to fit their region. As of September 2022, 171 municipalities have enacted ordinances on the establishment of local residents' associations, and 43 municipalities have enacted and operated enforcement rules for the ordinance. However, most local governments refer to the standard ordinance of the Ministry of the Interior and Safety and amend and enact the standard ordinance to suit local circumstances. They are reflected and used as they are. In most cities, counties, and districts, even if they have been operated as residents' autonomous committees or converted to residents' autonomous groups, they are still in the pilot implementation situation, and the full-scale practice of residents' autonomous associations has recently spread to a number of cities, towns and districts. The pre-legislative impact analysis on the standard ordinance of the residents' association provided by the Ministry of Public Administration and Security should be conducted so that each local government can serve as a reference material for enacting and revising the residents' association ordinance.
