헌법상 장애인과 아동의 기본권보장과 그 개정방안

국문 초록

우리 헌법은 제10조에서 제37조에 기본권을 규정하고 있다. 분류하자면 제10조에서 제23조까지는 자유권에 대하여 규정하고 있고, 제31조에서 제36조까지에는 사회적 기본권을 규정하고 있다. 이러한 체계를 통하여 보다 실질적인 기본권보장을 구현하여 오고 있다. 다만, 최근에 대두하고 있는 새로운 기본권으로서 연대권, 소외계층 또는 사회적 약자의 기본권(특히 장애인의 기본권보장), 아동의 권리보호 및 정보기본권 등에 대한 직접적인 규정은 포함하고 있지 않다. 헌법개정을 하지 않는 단계에서도 이러한 방법으로도 새로운 기본권의 보장을 이룰 수 있는 것이지만, 헌법개정에 이르게 된다면 이에 대하여도 새로운 기본권규범으로 체계화하는 것은 당연하다고 할 것이다. 여기서는 소외계층과 사회적 약자 및 아동의 기본권보장에 대해서만 언급하고자 한다. 첫째, 장애인의 기본권의 보장을 위한 명문규정을 둘 필요가 있다고 할 것이다. 예컨대 장애인의 기본권보장을 위하여 독일기본법 제3조 제3항 후단의 “누구든지 장애를 이유로 불이익을 받지 아니한다.”라는 규정하고 있으며 스위스헌법 제112C조 제1항에는 “주(州)는 노인 및 장애인에 대한 가정방문지원 및 재가서비스를 제공한다.”라고 규정하여 장애인에 대한 명문규정을 두고 있다. 둘째, 아동의 권리보호를 위한 규정을 둘 필요가 있다고 할 것이다. 일본헌법 제27조 제3항에 “아동을 혹사시켜서는 안 된다.”라고 규정하고 있으며 스위스헌법 제11조 제1항에 “아동 및 청소년은 특히 온전하게 보호받고 그 성장발달을 지원받을 권리를 가진다.”라고 규정하고 있다. 사회적 약자 중에서도 가장 약자인 장애인과 아동이 동등한 사회적 구성원으로서의 지위를 헌법으로부터 보장받을 수 있도록 하기 위해 공동체 구성원과 국가의 노력 의무를 명시하는 것은 우리 시대에 마지막 남은 인권적 과제이자 시대적 소명이라는 점에서 반드시 필요한 조항이라고 할 것이다. 즉 헌법개정에 있어서의 장애인과 아동의 기본권보장이 규정되어야 하는 이유는 장애인과 아동의 기본권보장을 통하여 현대헌법의 존재이유인 사회적 통합을 이루게 할 수 있기 때문이다.

영문 초록

Korea's constitution defines the basic rights in Article 10 to 37. To classify them, the articles 10 to 23 defines the right of freedom and the articles 31 to 36 defines the social basic rights. Although the arrangement of the basic rights does not realize their security, substantial security of basic rights are ensured through this system. However, the system does not include the regulations for the new basic rights arising recently including solidarity right, the basic rights of those alienated or socially weak (especially the security of the disabled), protection of children's right and information right. Although the new basic rights are secured by the above mentioned methods without amending the constitution, it is natural that those basic rights should be systematized into new basic right norms when the constitution is amended. I would like to mention only the security of the basic rights for the alienated class, the socially weak and children. First, there is a need for substantive enactment for the security of the basic rights for the disabled. For example, the German basic rights stipulates in Clause 3, Article 3 that "whoever it is, anyone shall not be disadvantaged because of his/her disability". The Switzerland constitution stipulates in Clause 1, Article 112 C "The state shall provide home visiting support and retirement service for the aged and the disabled" as a substantive enactment for the disabled. Second, there is also need for the substantive enactment for the protection of children's rights. The Japanese constitution stipulates in Clause 3, Article 27 that "Children shall not be abused" and the Switzerland constitution stipulates in Clause 1, Article 11 that "Children and youth shall have the rights to be protected thoroughly and supported in their growth and development." To secure the social status from the Constitution as the society members equally for the disabled and children who are the weakest among the social minorities, specifying the duties of the community members and nation is the must article in view of the humanity subject, that is left as a final in our generation, and summon of the times. In other words, the reason why the security of the disabled people's and childern's basic right under the Constitutional amendment is that it can realize the society integration which is the existence reason of the Constitution through the security of the disabled people's and childern's basic right.
