현 정부의 초.중등교육정책에 대한 헌법적 관점에서의 검토

국문 초록

이 논문은 헌법적 관점에서 보아 현 정부의 초.중등교육정책을 여하히 평가할 수 있을까 하는 문제의식을 갖고 쓴 것이다. 현 정부는 과거 진보정권인 노무현 정부의 극복을 목표로 하며 출발하였다. 교육에 있어서의 상반되는 두 가지 이념 즉 평등의 실현과 수월성의 추구 중에서 전 정부는 당연히 전자에 치중하였다. 그리고 현 정부는 수월성의 추구를 내세우며 기본적으로 세 가지의 정책을 내세워 실현해왔다. 그것은 첫째 여러 형태의 학교의 설립을 통한 학교의 다양화, 둘째 교사평가제의 시행, 셋째 전국학업성취도평가의 실시 등이다. 이러한 정책들은 모두 교육의 수월성 향상에 직접적으로 기여한다. 필자는 우리를 둘러싸고 있는 거대한 국내외적 변화의 흐름을 인식의 바탕 위에 놓고 우리 헌법이 갖고 있는 교육에 관한 규정에 대한 객관적 해석을 내리려고 한다. 우선 변화의 흐름으로 집어낼 수 있는 것은, 민주화, 세계화, 시장경제화 그리고 정보화사회의 도래와 후기정보화사회로의 이행 등을 들 수 있다. 이러한 변화의 컨텍스트 속에서 우리 헌법의 해석에 있어서 세 가지의 기본 틀을 추출해낼 수 있다. 첫째 교육에 있어서의 수월성의 추구, 둘째 학생의 인격적 성장, 셋째 열등한 처지의 학생에 대한 배려를 들 수 있다. 현 정부 교육정책은 수월성 추구에 기울고 있다. 이것은 교육에 있어서 시장의 원리를 도입하는 것으로 긍정적인 평가를 내릴 수 있다. 하지만 전반적인 교육에 관한 비전의 제시가 없을뿐더러, 연관 없이 나오는 개별정책들은 교육에 있어서의 수월성 추구 한 쪽에 기울고 있다. 우리를 지배하는 세계화의 거센 물결, 곧 도래할 후기정보화사회에의 대처 등에 관해 우리가 교육을 통해 이를 어떻게 해나갈 것이냐 하는 자세를 보이고 있지 않다. 영혼이 담기지 않은 껍데기의 교육정책이라는 혹평을 들을 수 있다. 국민과의 소통, 국민에 대한 설득을 게을리하며 일방적인 정책추구라는 비판을 면할 수 없다. 나아가 현 정부가 아직 포착하지 못하고 있는, 헌법에 근거한 다른 두 가지의 교육의 방향 즉 학생의 인격적 성장, 열등한 처지의 학생에 대한 배려 등이 존재한다. 교육의 현장에 있어서 학생의 인권은 중시되어야 하고, 또 난독증, ADHD, 자폐증의 아이들, 장애아, 가난한 가정의 아이들, 다문화가정의 아이들에 대하여 우리는 각별한 배려를 할 수 있어야 한다. 이에 관한 좀 더 정치하고 따뜻한 교육정책이 수립되어야 한다. 그러한 정책의 실현은 우리 국가가 민주국가로서 자신의 정체성을 주장할 수 있는 핵심요소이다.

영문 초록

This article was written on the purpose of a review on the policies for elementary and secondary school education by the current administration from the viewpoint of constitution, which started Feb. 2008 with strong objection to prior progressive government. As we know, we have two ideas conflicting each other in education, equalization and pursuiting excellence. The prior government led by late Roh Mu-Hyun president concentrated on the former, on the other hand the current Rhee Myung-Bak administration put weight on the latter, which has pursuited excellence in education by implementing the policies basically comprising of ① diversification of schools, ② teacher's appraisal system, ③ nationally standardized evaluation system of students' accomplishments. I'd like to center in the article on objective interpretation of our constitutional provisions about education after understanding the huge trends of changes occurred in and out of our nation. Firstly I picked up 3 international distinctive trends, ① democratization, ② globalization, ③ domination of free market economy, adding the advent of information society and near-future post-information society. Under such context of changes, we could extract 3 basic frames most important in education, which are ① pursuing excellence, ② character building, ③ caring for inferior students. To appraise policies of the present administration by interpreting constitution, pursuing excellence in education by introducing free market principle into the field of education would get affirmative grades. But the policies lack of visions overall. They just not have any picture needed in the midst of trends of prevalent globalization and to come up with post-information society. To use a severe metaphor, they are soulless policies. In addition to that, we must come up with another two ways of doing sound education, character building of students and caring for inferior disabled students, for example, with dyslexia, ADHD and so on. The children of poor families and multi-racial families are also carefully and warmly dealt with by more prudent educational policies. Such implementaion of policies is the core-ingredient needed for our nation to proclaim self-identity.
