개업공인중개사 관점의 부동산전자계약시스템의 개선방안과 정책적 제고방안

국문 초록

부동산전자계약시스템(IRTS)은 2016년에 도입하였으나 계약방식과의 실무적 차이, 부동산 전자계약시스템의 사용상 불편함, 개업공인중개사에 대한 홍보 및 교육 결여, 부동산전자계약시스템 내 중앙부처간 합의 미비에 따른 혼란 등 향후 보완해야 할 사안이 많다. 특히, 개업공인중개사의 부동산전자계약시스템(IRTS) 사용여부에 따라 그 활성화가 결정된다 해도 과언이 아니다. 부동산 계약현장에서 중개를 시작으로 계약서작성의 중요한 사용주체이다. 그럼에도 불구하고 거래당사자와 다른 사용주체들에 비하여 상대적으로 공인중개사의 실무적입장이 반영되지 못하고 있다. 이에 본 연구에서는 그동안 부족했던 개업공인중개사의 입장에서 부동산전자계약시스템을 접근하여, 전자계약시스템의 이용에 따른 불편한 문제점과 개선방안을 제시하여 문제점을 보완하고 이를 통해 부동산전자계약시스템의 정책적 확대, 서로 긴밀한 소통을 통해 정부와 개업공인중개사간 신뢰회복 등 부동산전자계약시스템의 정착적 요건을 제안하였다.

영문 초록

Although the Real Estate Electronic Contract System (IRTS) was introduced in 2016, there are many issues that need to be supplemented in the future, such as differences in practice with the contract method, inconvenience in the use of the real estate electronic contract system, lack of publicity and education for the opening public agencies, and confusion caused by the lack of agreement among central government departments within the real estate electronic contract system. In particular, it is not too much to say that the activation is determined by the use of the Real Estate Electronic Contract System (IRTS) by the opening public brokerage house. It is an important use agent for contract preparation starting with arbitration at the real estate contract site. Nevertheless, relative practical positions of authorized intermediaries are not reflected in comparison to those of parties and other users. In this study, we approached the real estate electronic contract system from the perspective of the opening public middleman, which had been lacking, and proposed the settlement requirements of the real estate electronic contract system, such as the policy expansion of the real estate e-commitment system and the restoration of trust between the government and the opening public through close communication, by suggesting the inconvenient problems and measures for the use of the electronic contract system.
