국문 초록

법정지상권의 성립을 전후한 지상건물의 건축을 둘러싸고 논란이 많은데, 법정지상권의 존재이유를 재검토하고 그를 기초로 지상건물의 건축이 법정지상권에 어떤 영향을 미치는지를 살펴볼 필요가 있다. 먼저 법정지상권의 존재이유로 건물철거의 방지라는 공익의 요청과 당사자의 의사 추정의 두 가지를 들 수 있는데, 공익적 고려는 보충적이어야 한다. 즉 당사자 사이에 토지용익에 관한 합의가 있으면 그에 의하고, 그러한 합의가 없더라도 당사자들의 정당한 이익이나 기대를 해치지 않는 범위 내에서 공익이 작동하여야 한다. 그리고 이러한 법정지상권의 존재이유에 기하여 지상건물의 건축이 어떤 영향을 미치느냐를 살펴보아야 하는데, 지상건물이 재축된 경우에 담보가치에 대한 법정지상권의 영향을 고려할 때 구건물을 기준으로 하는 법정지상권이 인정되어야 하지만, 공동저당의 목적인 건물이 재건축된 경우에는 담보가치에 영향을 미치지 않기 때문에 법정지상권이 인정되지 않아야 한다. 한편 관습상의 법정지상권과 관련하여 압류나 가압류가 선행하면 그 효력이 발생할 때를 기준으로 지상건물의 존재요건을 심사하여야 하고, 매매에 의한 경우에는 원인행위시를 기준으로 그 요건을 판단하여야 한다.

영문 초록

According to the Korean Civil Code, land and building thereto are separate immovables. Therefore, the right to use the land is inevitable for the existence of a building. Such a right is usually a right of lease, however, the Code also provides superficies. In Korean Society, contrary to the rare and unusual cases regarding the contractual superficies, the statutory superficies, including the customary superficies, is one the most controversy issues in theory as well as in practice. This situation seems to be the result of the insufficient inquiry into the purpose and the legal nature of the statutory superficies. This paper aims to examine the purpose and the legal nature of the statutory superficies. In my opinion, both the public interest, which prevents the demolition of the building, and the presumed will of the parties are the grounds for the statutory superficies. And the appendant nature of the statutory superficies is as a rule to be denied. The construction, which means to build a new building; to extend, alter, or rebuild an existing building; or to relocate a building, of a building may seriously affects the statutory superficies. This article also reviews the effect of the construction to the statutory superficies on the basis of the justification for existence of the statutory superficies, especially as regards reconstruction of a building or a building under the joint mortgages.
