중국 자산유동화제도에 대한 고찰

국문 초록

중국은 2001년 WTO에 가입하면서 금융업 개방이 확대되었고, 금융부문은 급속도로 변화되었으며, 최근 수년간 한국의 수많은 금융기업들도 중국시장에 진출하였다. 본문에서의 자산유동화제도는 기업이 부족한 자금을 조달하는 하나의 금융기법이고, 기존의 은행대출이나 사채 또는 주식의 발행과는 다른 구조를 가졌다. 자산유동화는 융자문제의 신흥금융제도이고 금융제도와 법률제도의 상호조화에 의해 형성되는 하나의 복잡하고 우월한 제도라 한다. 중국은 아직까지 한국과 달리 자산유동화에 관한 통일된 법제도는 없고, 자산유동화에 관한 규정은 여러 법률, 법규들에 분산되어 있다. 그 외에 자산유동화의 거래나 법률적인 구조면에서도 시장가치상의 실현을 살펴보면 중국의 자산유동화증권의 발행은 초기단계에 불과하다. 본 논문에서는 중국의 자산유동화 관련 현행제도를 살펴보고, 현 시점에서 자산유동화증권 발행에 따르는 문제점을 제기하였으며, 이에 상응하는 개선방안을 내었다.

영문 초록

After China’s access to the WTO in 2001, it gradually opened its domestic financial market to the world. Financial industry in China is now experiencing a rapid reform. In recent years, many Korean financial institutions have whereby entered Chinese financial market. In this paper, the system of asset securitization is a financial tool for enterprises in case of shortage of funds, and is different from traditional financing approaches of getting bank loans or issuing corporate bonds. Asset securitization is a new complicated but advanced financing means formed under mutual influence from finance and law. Different from Korea, China has no uniform legislation for the system of asset securitization. Relevant provisions for asset securitization are scattered in various laws and administrative regulations. Viewed from legal framework and market value of asset-backed security transactions, the issuance of asset-backed security is still in the initial stage in China. At first, this paper gives a summary of existing systems about asset securitization in China. Then, analyzes relevant issues existing in the issuance of asset-backed security and an attempt is made to find out relevant improvement plans.
