국문 초록
국제운송계약을 수행하는 중 사고가 발생하는 경우 계약 당사자의 합의에 의해 여러법이 적용될 수 있다. 이때 어떤 법을 적용하느냐에 따라 다른 결론이 나올 수 있다는문제가 있다. 이를 해결하기 위하여 각 국가는 해상운송에 발생하는 문제를 통일적으로해결하기 위한 노력을 기울여서 헤이그 및 헤이그-비스비 규칙과 함부르크 규칙을 제정하였다. 그러나 해당 규칙을 통일하고 최근 대두된 운송방식인 복합운송을 다루는 새로운 국제해상운송협약의 필요성이 대두되었다. 그 결과 10여년에 걸친 논의 끝에 로테르담 규칙이 채택되었다.
로테르담 규칙은 현재 사용되고 있는 국제운송협약을 최대한 존중하면서 기존 체제가 다루지 못하는 부분을 보완하는 형태로 운송질서의 변화를 시도하고 있다. 일반적으로 복합운송인은 화물에 손실이 발생하였을 경우 청구인에게 전 구간에 대하여 책임을진다. 그러나 로테르담 규칙을 복합운송에 적용할 경우 관련 당사자에게 균일한 책임이적용되지 못할 수 있는 문제가 있다. 따라서 본 논문은 비해상운송구간의 관련 당사자와 해상운송구간이 어떻게 다르게 책임이 적용될 수 있는지에 대하여 중점적으로 검토하고자 한다.
로테르담 규칙은 해상운송에 대하여는 강행성을 지니고 있으나 비해상운송구간에 대하여는 어떠한 조건을 규제하고 있지 않다. 따라서 비해상운송구간을 담당하는 하수운송인의 경우 책임한도가 로테르담 규칙보다 낮은 운송협약이 적용 가능한 경우 해당협약을 적용할 것이다. 이 경우 복합운송인과 해상운송을 수행하는 하수운송인이 부담하는 책임이 증가할 가능성이 있다. 해당 요인으로 인하여 복합운송인과 해상운송구간관련 당사자의 보험료가 인상될 수 있고 결국 화주의 부담이 증가되는 결과로 이어질수 있다.
따라서 우리나라가 로테르담 규칙의 가입을 검토할 때 해당 문제점과 관련된 신중한접근을 하여야 한다. 또한 해당 규칙의 적용에 관하여 국내의 화주 또는 운송인이 로테르담 규칙 적용으로 책임이 증가될 수 있다는 사실을 인지하고 이에 대한 법적 쟁점의검토와 대응 전략 마련이 필요하다. 예를 들어 해당 규칙을 적용하는 것이 유리하다면 운송구간에 해당 규칙의 당사국을 넣어서 강제적으로 적용되도록 하거나, 적용하지 않도록 할 경우 운송구간에서 해당 규칙의 당사국을 제외할 수 있다.
영문 초록
If an accident occurs whilst executing an international shipping contract, there are several laws that may be applied per agreement of the contracting parties. A problem that can arise with this is that different conclusions can be drawn depending on which law is applied. In order to resolve this, many countries made efforts to have a uniform set of rules for the carriage of goods by sea and ratified international conventions such as the Hague Convention, the Hague-Visby Rules and the Hamburg Rules. However, the need for a new international treaty on contracts for the carriage of goods by sea that unifies the previous conventions and also dealing with the currently emerging multimodal transportation became apparent. As a result, the Rotterdam rules were established.
The Rotterdam Rules attempts to change the rules of transportation by supplementing the areas that are not covered under the existing system of treaties, whilst respecting the international conventions that are currently in use to the greatest extent possible. Generally, a multimodal carrier is liable for damages to the cargo-owners for the entire carriage. However, there is a problem that if the Rotterdam Rules are applied to multimodal transport, uniform liability can not be applied to the parties concerned. Therefore, this paper focuses on the differences in the liabilities applying to contracts that include and exclude a sea leg.
The Rotterdam Rules have a mandatory nature for maritime transport, but does not have any regulations in pertaining to non-maritime transport legs. Therefore, subcarriers that are only responsible for transport covering non-maritime legs will where possible, apply an international treaty with lower liabilities. In this case, there is a possibility that the liabilities of multimodal carriers and sub-carriers that are responsible for a sea leg, increase. These factors can lead to an increase in the insurance premiums of multimodal carriers and sub-carriers responsible for a sea leg, which in turn can result in increased burden on the cargo-owner.
Therefore, in considering the ratification of the Rotterdam Rules, Korea should take a cautious approach in relation to the abovementioned problem. Further, the fact that a domestic/Korean cargo-owner or a carrier may have increased liabilities on the ratification of the Rotterdam Rules must be recognized and the legal issues should be reviewed and a mitigation strategy prepared. For example, if it is advantageous to apply the rules, a contractual party from a signatory nation can be included on that carriage leg so that there is mandatory application of the rules, or a signatory nation can be excluded from a carriage leg to avoid the application of the rules.
