SW발명에 포함된 캐릭터의 특허법적 보호방안

국문 초록

온라인 게임이나 애니메이션 등의 영상저작물에 등장하는 캐릭터는 저작권법에 의하여 보호되는 미술저작물에 해당된다. 다만, 특정 스토리나 과제를 해결하기 위하여 사용자에 의해 조작되는 SW발명에 포함된 캐릭터는 상업적 이용성 등 그 자체로서 상당한 가치를 가지고 있기 때문에 법적으로 보호할 필요성이 있다. 캐릭터가 미술저작물로 보호되는 객체는 캐릭터의 모양 자체이므로 캐릭터의 명칭이나 제호, 캐릭터의 제어장치나 제어방법 등의 기능에 대해서는 저작권법 보호대상이아니다. 캐릭터의 명칭이나 제호는 상표법에 의하여, 캐릭터의 제어장치나 제어방법은특허법에 의하여, 또 캐릭터가 물품의 액정화면 등 표시부에 표시되는 도형인 경우에는디자인보호법으로 보호되고 있으므로, 법률 상호간의 충동문제가 발생하게 된다. 캐릭터가 포함된 SW발명에서는 사용자의 조작에 의하여 형상이 변화하거나 위치 이동되는 캐릭터의 입체적 형상을 청구범위에 특정하여 기재할 수 있도록 하는 제도의도입이 필요하다. 즉, SW발명에 포함된 캐릭터의 입체적 형상을 청구범위에 특정하는경우에는 그 입체적 형상의 캐릭터가 특허발명의 구성요소로 간주되어서 보호범위적인기능을 가질 수 있도록 특허성 인정기준이 정립되어야 할 것이다.

영문 초록

Characters coming on the cinematographic work of the on-line game or animation etc. correspond to the art work protected by the copyright law. Only characters included in the SW invention operated by the user in order to solve a specific story or a task is needed to be legally protected since they have a considerable value for themselves such as commercial usability etc. An object in that the character is protected to the art work is a shape itself and a name or a title of the character, a function of a control apparatus or a controlling method etc. of the character are not the target to be protected under the copyright law. The name or the title of the character is protected by the trademark law, the control apparatus or the controlling method of the character is protected by the patent law, and in case where the character is a figure displayed on the display unit such as the liquid crystal display of the material etc., it is protected by the design protection act, and a conflict between the mutual laws will be generated. In the SW invention in that the character is included, it is needed to introduce a system allowing to describe by specifying the character s three dimensional shape where the shape would be changed or the position would be moved by the user s operation in claims, that is, in case of specifying the three dimensional shape of the character included in the SW invention in claims, the approval standard of the patentability should by established so that the three dimensional shape of the character would be regarded to elements of the patent invention to have the function of the protective scope.
