SPS협정상 투명성 원칙의 해석 및 적용에 대한 연구

국문 초록

SPS협정 제7조 및 부속서 B는 투명성 원칙에 대해서 규정하고 있다. 투명성 원칙이란 회원국이 SPS규정을 변경하고자 할 때 그 협정이 발효되기 전에 미리 다른 회원국에게 알려서 다른 회원국으로 하여금 의견을 제시할 수 있도록 하거나 규정을 준수할 수있도록 준비할 시간을 제공하기 위한 원칙이다. 투명성 원칙은 SPS협정 제2조, 제5조의 과학적 증거주의에 관한 쟁점 다음으로 많이다투어지는 쟁점이기는 하지만, SPS협정상 다른 주요의무와 비교해서 그 내용이 어렵거나 조항이 모호하지는 않다. 그러나 SPS협정상 다른 의무들의 경우 조항이 불명확하여 조항의 해석을 어떻게 하느냐에 따라 의무 이행여부가 달라질 소지가 존재한다면, 투명성 원칙의 경우 SPS규정을 채택단계에서 공표하였는지 여부, SPS규정을 제안단계에서 조기에 공고하고 통보하였는지 여부가 증거를 통해서 명확히 나타나기 때문에 공표를 하지 않았거나 조기에 공고와 통보를 하지 않았다면 더 이상의 반론의 여지는 없어진다. 따라서 SPS 제7조 및 부속서 B에 대한 진지한 이해가 필요하다. 부속서 B는 총 11개의 단락으로 이루어져 있으며, 투명성 원칙에 대한 실질적인 내용은 SPS규정의 발효전 채택단계에서의 의무를 규정하고 있는 첫째, 둘째 단락과 문의처에 대해서 규정하고 있는 셋째 단락, SPS규정이 채택되기 전 제안단계에서의 통보절차를 다루고 있는다섯째, 여섯째 단락이라고 할 수 있다. 또한 부속서 B의 이해를 돕기 위하여 SPS위원회가 채택한 투명성 의미 이행을 위한 절차 지침이 있으므로 이 지침에 대한 이해도필요하다.

영문 초록

Article 7 and Annex B of the SPS Agreement elaborate the transparency obligations. The aim of the transparency in SPS Agreement is to inform other Members about new or changed SPS regulations in order to give opportunity to submit comments and allow time for exporting Members to adapt to the new requirements. Problems regarding the transparency are disputed often in WTO with the science based obligations in Article 2 and 5, but comparing to other main duties, the contents of its provisions are not complicated or ambiguous. For this reason, if a Member did not provide informations on its SPS measures in accordance with the provisions of Annex B, the Member can not contend to the Panel. In other cases, for example, the science based obligations or adaptation to regional conditions, there are some room for interpreting differently because their provisions are somewhat general and nebulous, but in this situation to determine whether the Member has acted inconsistently with Article 7 and Annex B of the SPS Agreement is simple. Accordingly, being well-acquainted with Article 7 and Annex B of the SPS Agreement is necessary. An inconsistency with the provisions of Annex B results in an inconsistency with Article 7. Annex B are composed of 11 paras, the core contents of transparency are in para 1, 2, 3, 5 and 6. To assist Members fulfill their transparency obligations, there is recommended procedures adopted by SPS Committee. It needs to be aware of that procedures, also.
