동성애 군인의 규제에 대한 헌법적 재조명

국문 초록

본 논문은 우리나라의 경우 동성애자인 일반인에 대한 비규제적인 태도와는 달리 군인신분인 동성애자에 대해서는 예외적으로 규제적인 양상을 나타내고 있는 점에 주목하여 동성애자인 군인에 대한 ‘처벌과 차별대우’를 예정하고 있는 부분의 위헌성 판단에 도움을 얻고자 미국에서 실시되고 있는 정책인 “불문부답법”을 주된 고찰대상으로 한다. 즉 동성애자들의 군복무를 암묵적으로 허용하면서도 공개적으로 그러한 성적 취향에 대해 거론하지 못하도록 한 것 이 불문부답법의 핵심적인 내용인바 동 법령에 의한 정책이 병역의무를 이행케 하면서도 동성애 군인이 겪게 되는 차별적 취급을 줄이기 위한 하나의 방법으로 미국에서 고안되었기에 이를 통해 우리가 시사 받을 점이 있다고 보여진다. 본 논문은 동성애군인에 대한 미군부의 태도와 연방 법원의 태도를 시기적 관점에서 고찰할 뿐만 아니라 나아가 관련 법령과 미국 연방법원의 판례를 통해 미국의 군대 내부에서 동성애자의 배제에 관한 역사와 배제조치에 대한 법적 근거로 제공된 불문부답법을 헌법적으로 재조명하고자 한다. 또한 불문부답법을 사생활권, 평등권, 표현의 자유의 관점에서 검토한 미국 연방판례의 입장에 더하여 “양심의 자유”의 내용 중에서 양심실현의 자유에 대한 침해도 될 수 있다는 점을 지적하고자 한다. 이러한 비교법적 고찰은 앞으로 우리가 그와 유사한 법령을 채택하려 할 때 동 법령의 위헌성 판단에 중요한 근거가 될 수 있을 것이다. 결론적으로 우리가 앞으로 동성애 군인의 지위보호와 관련한 법령을 입안함에 있어서는 미국에서 채택되어 있는 불문부답법의 한계를 넘어서야만 한다고 본다.

영문 초록

This article is focusing on constitutional analysis of the fact that there has not been any regulations prohibiting the homosexuality in Korean society, whereas the Korean military has prohibited male soldiers from having sex with other same gender military personnel. Since this kind of discrimination should be considered as unconstitutional, this article aims at comparative study to point out unconstitutionality of the Korean military policy and to get helpful analysis of, so to speak, "Don't Ask Don't Tell Act" in the United States. Under the new policy of Don't Ask Don't Tell in the United States, gay personnels in the military can continue to give service, unlce, they come out to say that they are homosexual or that they have sex with other same gender military personnels. This policy has been implcmented to allow gay personnels to continue their service without being discriminated by the military in terms of having homosexuality. Thus, this article examines the military's attitude toward gay personnel and the federal courts' view over gay ban according to time sequence from the past to the pmilent. In addi out tthe gay ban ry caed federal law, as we saw above, namely, Don't Ask Don't Tell Act, is examined by means of analysis of federal courts' cases in which Don't Ask Don't Tell Act allegedly infringes the constitutional right of the homosexual military personnel. On toinof that, this article insists that Don't Ask Don't Tell Act should be viewed as it is repugnant not only to protection of the right to priva cy, the equal protection, and the freedom of expression but also to the constitutional protection of the freedom of conscience. By way of this comparative study, we will get more reasonable grounds to decide the unconstitutionality of the similar law which can be implemented to the Korean military soil. In conclusion, in order to get endorsement for a policy protecting the right of gay personnel in the national assembly, we should overcome the limitation of Don't Ask Don't Tell Act's policy.
