학습권 보장과 학교폭력 해결 굴레에 갇힌 학생인권 논쟁에 대한 고찰: 교권과의 관계를 중심으로

국문 초록

본 연구는 학생인권조례 도입 이후 지속적으로 제기되는 학습권 보장과 학교폭력 해결이라는 굴레에 주목하고, 그 굴레의 논리 구조를 탐색하기 위해 수행되었다. 이를 위해 학생인권조례 도입 당시부터 현재까지의 정책연구, 학술논문과 2022년 1월부터 2023년 6월까지의 학생인권 관련 언론보도, 기사, 토론, 관련 댓글 등을 수집하여 질적 내용 분석을 수행하였다. 연구 결과, 학습권 보장과 학교폭력 해결이라는 굴레의 주요 논점은 다수 학생의 권리, 소수 학생의 일탈 행위, 수업을 방해하는 행위, 교권, 교사의 지도권과 수업권, 체벌 부활로 이어짐을 확인하였다. 중요한 것은 이 굴레의 기본 전제는 과거 전통적인 교육관에 기초한 학생다움과 결과중심교육, 그것을 위한 교사의 권위, 권한이 제한됨에 따른 갈등으로 나타났다. 또한, 그 갈등을 강화시키는 기제로서 학부모의 문제도 끊임없이 나타났다. 본 연구 결과를 중심으로 향후 학생인권 논쟁의 새로운 지평을 열기 위해서는 학습권 보장과 학교폭력의 법적 해결이라는 굴레에서 벗어나야 함을 논의하였다. 구체적으로 교육 주체들의 교육적 관계 정립과 미래사회에 필요한 학교 교육의 역할, 이에 따른 교사와 학생의 상을 구상함으로써, 보다 인권친화적이며 안전한 학교를 기대할 수 있을 것이라는 점을 제언하였다.

영문 초록

This study aims to explore the logic of restraints consisting of the guarantee of the right to learn and the resolution of school violence. To this end, this study conducted qualitative content analysis. The findings of this research proved that the main point of the logic of the guarantee of the right to learn and the resolution of school violence are the bonded issues such as the rights of the majority of students, few students’ deviant behaviours, acts of hindering classes, teachers’ rights to discipline and teach, and reinstating corporal punishment. Importantly, the premises of this point are on the role and duty of students based on traditional thinking on education and the stress on educational excellence, and finally, the teachers’ authority. The conflicts between teachers and students occurred, and the influence of parents has escalated the conflicts. Based on this finding, I argued that we must eliminate such restraints to raise new ideas and paradigms of students’ human rights issues. In concrete, I discussed that educational agents should bring ideas together based on the educational relationship and map out the role of schools for future society and education so that in the end, we can expect safe and human rights-friendly schools.
