국문 초록

본 연구는 하버마스와 슈미트의 관점을 대결을 통해 코소보에서의 인도적 개입 사례를 해석해 보았다. 이는 현재 진행 중인 우크라이나 전쟁에 특히 관련이 있다는 점에서 시의성을 지닌다. 우크라이나 전쟁은 미국 패권의 쇠퇴의 단편으로 고려되고 있지만, 그 본질적 요소에 대한 메타이론적 논의는 아직 부재하다. 사실 미국의 자유주의 규범의 이중성(인권보호-인권개입) 그리고 인권과 국가 주권(불가침주의) 간의 상호 간섭은 상당한 긴장을 발생시키고 전환기적 국제질서의 근간을 흔들고 있는 주요한 요소라는 점을 본 연구는 주목한다. 이를 위해 본연구는 현재 진행되고 있는 우크라이나 전쟁 보다 완결된 사건인 코소보 사례를 통해 논의를 심화해 보았다. 이는 인권 보호를 위한 개입의 딜레마를 보여주며, 이는 현재 우크라이나에서 벌어지고 있는 사건들과 밀접하게 유사하다는 점에서 유의미 한 사례다. 많은 학자들은 이러한 사건들을 미국 패권의 쇠퇴를 나타내는 것으로 해석하지만, 근본적인 문제는 인권과 주권 간, 그리고 개입과 보호 간의 갈등에 있기 때문이다. 더 나아가 이는 미국 규범에 대한 도전이며 더불어 자유주의 규범의 파탄, 그리고 미국 패권의 쇠퇴에 관한 담론의 정치철학적 근간을 드러낸다는 점에서 유의하다. 즉, 인권과 주권의 본질을 미국 패권의 쇠퇴와 다극화의 상승이라는 더 큰 맥락에서 비판적으로 분석하는 것이 중요합니다. 우크라이나 전쟁의 결과는 여전히 불확실하지만, 이 연구는 새롭게 떠오르는 국제 질서 내에서 추구해야 할 목표를 결정하는 것을 목표로 한다.

영문 초록

This study examines the humanitarian intervention in Kosovo through the perspectives of Habermas and Schmitt, highlighting its relevance to the ongoing war in Ukraine. It points out that while the Ukraine war is seen as part of the decline of US hegemony, there is a lack of in-depth theoretical discussion on its core elements. The study emphasizes the tension created by the duality of US liberal norms (human rights protection vs. intervention) and the conflict between human rights and state sovereignty. Using the concluded Kosovo case, it illustrates the dilemma of intervention for human rights protection, mirroring the situation in Ukraine. The study argues that the key issue lies in the conflict between human rights and sovereignty, and intervention and protection, revealing the collapse of liberal norms and the philosophical underpinnings of US hegemony’s decline. It underscores the importance of critically analyzing human rights and sovereignty within the broader context of the decline of US hegemony and the rise of multipolarity, aiming to identify objectives for the emerging international order.
