국문 초록

본 연구는 소유잠재성의 시각에서 조선시대~현재에 이르기까지 상속제도와 잠재적 소유가 현재 저출산 현상과 인간 행동에 준 영향 등을 살펴보고 대안을 제시하는 것에 그 목적이 있다. 과거-현재지향적 상속제도에서는 자원의 과거 세대 분산, 현재 세대 집중의 현상으로 이어졌으며, 동시에 출산의 행위 또한 다르게 해석 되었다. 조선시대 출산은 노동력 증가에 따른 자산 증가를, 오늘날 출산은 양육 과정에서 비용 발생에 따른 자산 감소를 예상하게 됨으로써, 출산율이 낮아지는 추세에 있다. 미래지향적 상속제도는 현재 세대에 집중된 자원을 미래 세대의 출산으로 분산하기 위한 대안 제시로써 의미를 가진다. 이는 각 가문의 지속가능성과 연관된 것으로, 부모-자녀 상속 상황에서 피상속인의 재산은 조상 대대로 형성된 것이라는 점에서 상속인의 자격은 미래세대(피상속인의 손자녀)의 존재에 초점에 맞춰야 한다. 이는 현재 상속 제도 하에서 경쟁 패러다임을 변화시키는 것을 의미한다. 잠재적 피상속인에게 출산을 결심한 자녀는 육아로 인한 자산 감소를 상속 재산으로 보상받을 수 있다고 기대함에 따라, 미혼이거나 딩크(DINK)족에게는 미래의 상속 시점에 소외될 수 있다는 불안감을 주게 됨으로써 출산의 동기를 촉진할 수 있게 된다.

영문 초록

The purpose of this study is to examine the influence of the inheritance system and Possession Potential on the current low birth rate phenomenon and human behavior from the Joseon Dynasty to the present from the perspective of Possession Potential, and to suggest alternatives. The past-present oriented inheritance system led to the phenomenon of dispersion of resources among past generations and concentration of resources in the present generation, and at the same time, the act of giving birth was also interpreted differently. In the Joseon Dynasty, childbirth was associated with an increase in assets due to an increase in the labor force, and today, childbirth is expected to decrease assets due to costs incurred during the child-rearing process, so the birth rate is on the decline. The future-oriented inheritance system is meaningful as an alternative to distributing resources concentrated in the current generation to the birth of future generations. This means changing the competitive paradigm under the current inheritance system.
