자백의 증명력과 보강증거

국문 초록

증명력은 어떠한 사실을 증명할 수 있는 증거의 실질적 가치를 말하는 것으로 현행법은 자백을 이유로 유죄판단을 하기 위해서는 보강증거가 요구된다는 원칙을 제310조에 규정하고 있다. 자백의 보강법칙은 그 근거로 허위자백으로 인한 오판의 방지와 자백편중의 수사로 인한 인권침해를 방지하기 위해 그 필요성이 있다고 볼 수 있다. 따라서 보강법칙을 위반한 경우 항소이유 및 상고이유로 된다는 점에는 의문이 없다. 한편 유죄판결이 확정된 후에는 비상상고이유가 된다는 견해가 있으나, 의문이 없지 않다. 즉 자백배제법칙이 자백의 증거능력에 관한 것임에 반하여, 자백의 보강법칙은 자백의 증명력에 관한 것이다. 증거능력이 인정되는 자백에 기하여 유죄의 심증을 얻었음에도 불구하고 보강증거가 없으면 유죄의 판단을 하지 못하도록 한다는 점에서 자백의 보강법칙은 공판조서의 증명력과 함께 자유심증주의의 예외를 이룬다고 볼 수 있다.

영문 초록

Evidential power refers to the substantial value of the evidence that can prove the true value. The current law, as in Article 310, stipulates that the conviction based solely on the confession should be implemented by supporting evidences. The principle of corroboration to the confession is viewed as necessary, in order to prevent the false judgment caused by the false confession or to steer clear of human rights infringements that come from the confession-centered investigation. Therefore the breach of the corroboration principles should naturally lead to the appeal to the higher courts. Some, on the other hand, hold the view that it can also be the ground for the Extraordinary Appeal once it is found after conviction, which is rather controversial. As such, the exclusionary rule of confession is for the admissibility of confession as an evidence, while the Corroboration principle is about the evidential power of the confession. The ban on the conviction without supporting evidence, even when there is sufficient circumstantial evidence in the confession deemed to have evidential power renders the corroboration principle the to be exceptional to the rule of free and independent findings of fact, in addition to the evidential power of the protocols to public trials.
