공공기관 유사행정규제 관리 사례분석

국문 초록

유사행정규제란 국가 및 지방자치단체로부터 권한을 위임받은 공공기관이 특정한 행정목적을 수행하기 위해 국민의 권리를 제한하거나 의무를 부과하는 것으로 각종 정관, 약관 및 내규 등에 규정되는 사항을 말한다. 공공기관의 업무와 규모, 그 수를 감안할때 유사행정규제가 정부 규제에서 차지하는 비중이 적지 않음에도 그동안 정부의 규제혁신 과정에서 유사행정규제는 주목받지 못했으나, 최근 규제혁신의 체감도를 높이기위해 공공기관의 유사행정규제에 대한 심의와 관리가 정부 규제입증책임제의 일환으로 우리나라에서 시작되었다. 하지만 유사행정규제라는 개념조차 생소한 상황에서 유사행정규제의 규제성과 타당성을 검토해야 하는 공공기관과 실무자들은 유사행정규제 식별과 관리에 있어 많은 혼선과 어려움을 경험하고 있다. 이에 본 연구에서는 한국자산관리공사의 경험을 분석하여 향후 유사행정규제 관리를 효과적으로 운영하는데 필요한 이론적 실무적 시사점을 도출해 보았다. 개선･폐지･신설된 내규에 대한 유사행정규제 성과유형을 분석한 결과 유사행정규제에 해당한다고 보기 어려운 내규 사항을 유사행정규제로 보고 심사하여 해당 조항을 개선･폐지 신설한 경우가 가장 큰 비중을 차지하고 있으며, 유사행정규제의 정의에 해당하지는 않으나 그와 유사한 규제적 효과를 유발하는 내규도 상당히 많음을 확인하였다. 이러한 분석을 통해 효과적인 유사행정규제 관리체계를 구축하고자 할 때 유용한 시사점을 세 가지 도출하였다. 첫째, 유사행정규제의 개념범위에 권리 제한과 의무 부과 외에 법적 이익의 제한 및 부담 부과를 포함해 관리할 필요가 있다. 둘째, 유사행정규제 판단 기준을 정립하여 실무자들이 숙지하도록 안내할 필요가 있다. 셋째, 유사행정규제 관리의 실효성을 높이기 위해서는 관리방식을 다양화할 필요가 있다.

영문 초록

Quasi-regulations refer to matters stipulated in various articles of incorporation, terms and conditions, and by-laws that limit the rights of citizens or impose obligations on public agencies delegated by the state and local governments to carry out specific administrative purposes. Considering the size and number of public agencies in Korea, quasi-regulations account for a considerable portion of government regulation, but quasi-regulations have not received much attention in the government's regulatory innovation process in Korea. However, in order to enhance the perception of regulatory innovation, the deliberation and management of quasi-regulations by public agencies has recently begun in Korea as part of the government regulatory verification responsibility system. However, in a situation where even the concept of quasi-regulations is unfamiliar, public agencies and practitioners who have to review the regulatory nature and feasibility of quasi-regulations in the field are experiencing a lot of confusion and difficulties in identifying and managing quasi-regulations. Therefore, in this study, the experience of Korea Asset Management Corporation was analyzed to derive theoretical and practical implications necessary for effective management of quasi-regulations in the future. First, it is necessary to manage the conceptual scope of quasi-regulations, including restrictions on legal benefits and imposition of burdens, in addition to restrictions on rights and imposition of duties. Second, it is necessary to establish standards for judging quasi-regulations and guide them to familiarize themselves with them. Third, it is necessary to diversify the management method in order to increase the effectiveness of quasi-regulations management.
