러시아의 정부형태의 분류에 관한 일고찰

국문 초록

대다수 학자들은 오늘날 러시아의 정부형태를 대통령제로 분류하지만 일부에서는 러시아의 정부형태를 이원정부제로 보기도 한다. 이러한 견해 차이는 러시아가 헌법상 대통령제와 의원내각제의 요소를 모두 가지고 있는 일종의 절충형 정부형태에 해당하는데서 기인한다. 그러나 이러한 헌법상 특징에도 불구하고 지금까지 실제로 러시아의 정부형태는 강력한 대통령제로 운용된 것으로 평가받는다. 특히 총리의 임명이나 해임과 관련하여 대통령과 의회가 대립하였던 대부분의 정치적 사건에서 의회는 대통령의 의사에 굴복하여왔다. 이원정부제는 대통령과 의회의 의견이 일치하지 않을 경우 의회중심의 국정운용을 가능하도록 고안된 제도라 할 수 있다. 일부 학자들이 러시아의 정부형태를 이원정부제로 분류하려는 시도는 그러므로 러시아에서 의회중심의 국정운용 가능성을 모색한다는 차원에서 이해될 수 있을 것이다. 그러나 실제로는 그동안 러시아에서 이원정부제 고유의 현상인 동거정부의 출현이 드물었다. 이러한 현상의 원인은 서구의 이원정부제 국가들과 비교하여 볼 때 양대 정당제 내지는 정당블록이 형성되지 않는 현 러시아의 정당제의 문제고 할 수 있다. 그러므로 향후 러시아에서 이원정부제적 정국의 운용이 가능할 것인지 다시 말해 동거정부의 출현이 가능할 것인지의 여부도 정당제의 발전 추이에 달려 있다고 볼 수 있다.

영문 초록

The government system of 'the Russian Federation'(Russia) is usually grouped into presidentialism. On the other hand, some scholars classify the Russian government system as dual executive or semi-presidentialism. It is because that both elements of presidential and parliamentary system can be found in the Russian constitutional law. For all, Russian government system is applied as super-presidential system in many political cases, such as the appointment and dismissal of prime minister. A weak vote of no-confidence means that the Russian legislature has little control over the selection of the prime minister and cabinet. One important characteristic of dual executive system is that the parliament is superior to the president when both constitutional institutions disagree on some political event such as dismissal and appointment of prime minister. So dual executive system has some profit in consolidation of democracy and parliamentarism. In this point of view, this paper explores the possibility that Russian government system is managed as dual executive system. This paper pay attention particularly to the reason why the Russian parliament is weak. Comparing the Russian government system to other countries whose government system is usually grouped into dual executive, such as French 5th Republic and Austria, it can be argued that the uniqueness of Russian one party system is the reason of the weakness of the Russian parliament and severely hobbles Russian government system. Therefore, this paper conclude that the advent of 'Cohabitation' like French 5th Republic in Russia is dependent on the development of Russian party system.
