국문 초록

한국은 민주주의가 형성되는 과정에서 국가 공권력에 의하여 국민의 기본권이 과도하게 제한되거나 침해된 사례가 있기에 국민은 공권력에 민감하게 반응하거나 경시하는 풍조가 팽배해 있다. 특히 200년대 이후 많은 사례에서 볼 수 있듯이 국민은 실정법 질서를 불신하는 태도를 보이고 있다. 그러나 국민에 의해 기초질서가 지켜지지 않는 국가는 선진국이 될 수 없으며 또한 법치국가로서의 기능을 다하지 못한다는 현실을 우리가 직시하여야 할 당면 과제이다. 무엇보다도 국가 공권력의 상징이라고 할 수 있는 경찰의 정당한 법집행에 대한 신뢰가 무너진 현실은 많은 불특정 다수의 국민들에게 충격을 안겨주고 있다. 이를 방지하기 위해서는 우선 사회지도층 인사들의 법질서 존중의식이 확산되어야 하고 또한 이를 위반할 시에는 지위고하(地位高下)를 막론하고 사법부에 의한 엄정하고 공정한 법집행이 선행되어야 할 것이다. 만약에 사회지도층의 모범적 법질서 준수의 선행을 전제한 한 기초질서의 확립은 국민 개개인의 준법의식 증대를 기대할 수 있을 것이다. 그리고 기초질서 중에서 불법 집회시위와 관련하여 경찰의 엄정한 법집행도 중요하지만 경찰의 법집행에 대해서 국민들의 무한한 신뢰를 받을 수 있는 여건이 형성되도록 하여야 할 것이다. 이를 위하여 언론에서 국민의 여론에 대한 공정한 보도와 국가안보 및 사회질서를 염두에 둔 보도가 필요하다고 판단된다. 공권력 무력화 현상은 민주 사회의 성숙 과정에서 나타나는 과도기적 현상이라고 이해하는 것이 타당하다고 본다. 현대 사회에서 엄정한 법집행의 권위를 부여받고 있는 선진 국가들도 불과 수십 년 전에 공권력 무력화의 시기를 슬기롭게 극복했던 역사적 사실이 있기에 우리도 이를 지혜롭게 극복할 수 있으리라 기대해 본다.

영문 초록

It is true that public power of Korean government has excessively restrained or violated people's basic rights while forming democracy in Korea. So people are sensitive to or disregard public power. Especially since 2000 people have disregarded the laws as we could see in many examples. But we have to clearly understand that Korea can't be an advanced country and doesn't work as a constitutional state when people don't keep to basic rules. Above all many people are greatly affected by the fact that people don't respect the reasonable law enforcement by the police that is the symbol of national public power. To prevent it, people in upper classes should first have the mind to respect the laws. When they violate laws, they should be punished by strict and fair law enforcement no matter how high ranks they are positioned. When people in upper classes keep to laws successfully and establish basic rules, we could expect that it could improve law-abiding spirit among people. It is important for the police to enforce laws strictly when there are illegal demonstrations. But first it is more important to create conditions so that people can greatly respect the law enforcement of the police. To achieve the goal the press should report the public opinions fairly and consider national security and social order when it reports some news. It is reasonable that the disregard of public power is a transitional condition that appears when a country advances to a democratic one. Many advanced countries, which enforce laws strictly these days, have once experienced the disregard of public power among their people some years ago. But they passed the period smartly. So it is expected that Korea also pass the period smartly.
