교도소 내 성소수 수용자 처우 현황 및 개선 방안

국문 초록

세계적으로 소수자에 대한 인권 의식이 향상되면서 그동안 외면받아왔던 사람들에 대한 관심도 늘어났다. 거기에 미투 운동으로 인해 참고 있었던 피해자들의 목소리가 커지면서 공론화가 되기 시작했다. 그중에서도 성소수자는 세계적으로 오랫동안 차별받아왔고, 지금까지 사회는 성정체성과 성적지향의 다양성을 인정하지 못하고 거부해왔으며, 이유 없이 차별하고 혐오적인 존재로 낙인화 해 왔다. 특히 그동안 알려지지 않았던 교도소 내의 성소수자가 어떤 처우를 받고 있었는지 알아보고 앞으로 개선해 나가야 할 방안을 제시하고자 한다. 이와 관련된 연구를 살펴보면, 교도소 내의 성소수자는 충분한 의료적 환경을 제공받지 못하고 있었고, 차별 대우도 존재하고 있었다. 트랜스젠더의 경우 지속적인 호르몬 치료가 병행되어야 하고, 성정체성에 혼란을 겪고 있는 수용자의 경우 담당 의사의 상담이 필수인데, 교도소 내에서는 즉각적인 조치가 힘든 상황이었다. 그리고 성소수자라는 이유만으로 다른 수용자들과 격리시키는 경우도 있었는데, 엄연히 동등한 처우를 받아야 할 수용자가 별다른 이유 없이 차별받는 것은 그동안 성소수자에 대한 인식이 상당히 부정적이었다고 볼 수 있다. 우선 성소수자에 대한 개념을 정리하기 위해 성소수자의 개념을 분류해보면, 가장 대표적인 동성애부터 양성애, 무성애, 간성, 젠더퀴어 등의 성소수자가 존재한다. 그리고 교도소 내 성소수자의 처우를 개선하기 위해 가장 기본이 되는「형의 집행 및 수용자의 처우에 관한 법률」을 일부 개정할 필요가 있다. 가장 중요한 것은 성소수자 수용자가 받을 수 있는 특수한 의료 환경을 조성하는 것이다. 그리고 외국의 사례를 참고하여 성소수자 차별 금지 원칙을 제정하고, 성소수자 전용 교도소와 같은 전용 교정 시설의 설립 또한 고려해볼 수 있다. 유엔에서 발표한 ‘시민적 정치적 권리에 관한 국제조약’에 대한 우리나라의 인권정책 종합 보고서인 ‘유엔 자유권 규약 5차 보고서’에서 교도소 내의 성소수자에 대한 처우가 처음으로 언급되었다. 그동안 인권 문제에서 뒤처져있다는 평가를 받았던 우리나라에서 이러한 움직임이 나타났다는 것은 비약적인 성장이라고 볼 수 있다. 그러나 이제 초안이 발표되었을 뿐이기 때문에 앞으로 넘어야 할 과제가 많을 것으로 예측된다. 더 이상 외면받고 차별받는 사람들이 나타나지 않기 위해서는 가장 어려운 상황에 있는 교정 시설에서부터 개선해 나가는 것이 중요하다.

영문 초록

As awareness of human rights towards minorities has increased worldwide, interest in people who have been neglected has also increased. In addition, as the voices of victims who had endured the MeToo movement grew, the issue has become a public debate. Among them, sexual minorities have been discriminated against worldwide, and society has failed to accept the diversity of gender identity and sexual orientation, stigmatizing it as discriminatory and hateful for no reason. Therefore, in this paper, we examine how sexual minorities in prisons were being treated and suggest ways for improvement. Related studies regarding sexual minorities in prison show that sufficient medical conditions were not provided to sexual minorities in the prison, and discriminatory treatment existed. Although continuous hormone therapy is needed for transgenders and prisoners who are confused about their gender identity should be consulted by their doctors, it was found that taking immediate action is difficult in prison. In addition, in some cases, sexual minorities were quarantined by other inmates just because they were sexual minorities. Although prisoners should be treated equally to other inmates, the fact that they are discriminated against for no particular reason shows how bad the perception of sexual minorities has been. First of all, to clearly define the concept of a sexual minority, we classify sexual minority from the most representative homosexuality to bisexuality, asexuality, intersexuality, genderqueer, etc. And in order to improve the treatment of sexual minorities in prison, partial amendments of the most fundamental act, Administration and Treatment of Correctional Institution Inmates Act are needed. The most important thing is to create a special medical environment for sexual minority prisoners. In addition, the principle of prohibiting discrimination against sexual minorities can be considered by referring to foreign cases, and the establishment of dedicated correctional facilities such as prisons for sexual minorities can also be considered. The treatment of sexual minorities in prisons was first mentioned in the Fifth Periodic Report of the Republic of Korea on United Nations Human Rights , a comprehensive human rights policy report on the International Covenant on Civil and Political Rights released by the United Nations. The emergence of such a move in Korea, which has been evaluated as lagging behind in human rights issues, can be seen as a leap forward. However, since the draft has only been published, it is predicted that there will be a lot of work to be done in the future. Taken together, in order for sexual minorities to be no longer neglected nor discriminated against, it is important to improve the prison facilities that are currently poor for them to live in.
