재외국민 범죄피해 지원방안

국문 초록

해외에 나간 우리 국민의 범죄피해 소식은 더이상 낯선 이야기가 아니다. 최근에는 폭탄테러, 총기 난사 등 대규모 범죄뿐 아니라 동양인 대상 증오범죄도 기승을 부리고 있다. 신종 코로나바이러스 감염증(코로나 19)으로 해외여행이나 출장 등이 주춤한 모양새지만 백신 접종 등 방역 상황이 나아진다면 출국률은 가히 폭발적일 것이다. 그러므로 재외국민 관련 사건·사고에 관한 대책을 마련해야 한다. 국민의 안전한 국외 방문 및 거주·체류를 도모하기 위하여 2019년「재외국민보호를 위한 영사조력법」을 제정하였지만, 그간 제공한 영사조력은 외교부 지침에 근거하여 안정적인 대국민 서비스가 어려웠다. 물론, 2021년 시행되는「재외국민보호를 위한 영사조력법」은 재외국민의 보호 관련 법률의 필요성을 규정하고 있으며, 보다 효과적이고 체계적으로 재외국민들을 보호하고 관리해야 함을 강조하고 있다. 하지만 범죄피해자인 재외국민에게 제공하는 영사조력은 주재국 경찰기관에 신고하는 방법 안내, 신속하고 공정한 수사 요청, 의료 기관에 관한 정보 제공, 가능한 범위 내에서 변호사 및 통역인 명단 제공 등으로, 국내에서 범죄피해 시 받을 수 있는 직접적인 지원(치료비, 심리치료비, 장례비 등)은 전무하다. 「재외국민보호를 위한 영사조력법 시행령」제19조에서 규정하고 있는 ‘긴급지원비의 지원 의 경우도 원칙적으로는 재외국민이 영사조력 과정에서 자신의 생명·신체 및 재산의 보호에 드는 비용을 부담하여야 하고 ① 사건·사고에 처한 재외국민이 본인의 무자력(無資力) 등으로 인하여 비용을 부담하기 어렵다고 판단되는 경우 ② 해외 위난상황에 처한 재외국민이 안전한 지역으로 대피할 수 있는 이동수단이 없어 국가가 이동수단을 투입하는 경우만 국가가 그 비용을 부담할 수 있다고 규정되어 있다. 이에 본 연구는 해외 출장이나 여행 등으로 출국한 현지에서 범죄피해를 겪은 이들을 신속하게 보호하고 지원할 수 있는 실질적인 방안 모색에 그 목적이 있다. 이를 위해 재외국민의 범죄피해 실태와 실제 지원 사례를 바탕으로 현지에서 어려움을 겪게 될 자국민의 안전과 보호를 위한 방안을 제시하고자 한다.

영문 초록

The news of criminal victimization of our people abroad is no longer unfamiliar. Recently, not only massive criminal victimization such as bombings and shootings, but also hate crimes against Asians have been rampant. Although overseas travel and business trips seem to have slowed due to the novel coronavirus infection(Corona 19), the departure rate is expected to explode if the quarantine situation such as vaccination improves. As the number of overseas departures increases, the number of incidents and accidents against overseas Korean citizens will naturally increase, and countermeasures are needed. The Consular Assistance Act for the Protection of Overseas Citizens was enacted in 2019 to promote the safe overseas visits, residence and stay of the Korean people, but consular assistance has been provided based on the Korean foreign ministry s guidelines and public service has been difficult to be provided stably. The Consular Assistance Act for the Protection of Overseas Citizens, which takes effect in 2021, stipulates the need for laws related to the protection of overseas citizens, and emphasizes the need to protect and manage overseas citizens more effectively and systematically. However, consular assistance provided in case of crime damage to overseas citizens is to guide them to the police agency of the host country, request a quick and fair investigation, provide information about medical institutions, and provide a list of lawyers and interpreters to the extent possible. There is no direct support(for physical and psychological treatment, and funerals, etc.) that can be provided if the crime has happened in Korea. In principle, in the case of emergency support expenses prescribed in Article 19 of the Enforcement Decree of the Consular Aid Act for the Protection of Overseas Citizens, overseas citizens shall bear the costs incurred in protecting their lives, bodies and property in the consular aid process. It is stipulated that a) if an overseas citizen in an accident or accidents finds it difficult to pay for the expenses due to his/her financial circumstances, etc., and b) there is no means of transportation for an overseas citizen in an overseas crisis to evacuate to a safe area, the country can pay the expenses only. In response, the purpose of this study is to find practical ways to quickly protect and support them when they suffer from criminal victimization after leaving the country due to overseas business trips or travel. To this end, I would like to present measures for the safety and protection of our citizens who will have difficulties overseas, based on the actual circumstances of crime victimization and actual support cases of overseas Korean nationals.
