자치경찰제 시행 이후 가정폭력 피해자 보호 및 지원 방안

국문 초록

시·도 경찰청장은 2021년 7월부터 ｢국가경찰과 자치경찰의 조직 및 운영에 관한 법률｣에 의거하여 시·도 경찰위원회 지휘·감독을 받아 가정폭력 등 자치사무 업무를 지휘·감독한다. 이로써 지자체와 자치경찰은 상호인프라를 통해 가정폭력 피해가정과 피해자를 보호·지원할 효과적인 솔루션 구축이 가능하다. 이에 본 연구는 가정폭력 보호제도 및 피해자 지원제도 파악을 위해 경찰청이 운영하는 학대예방경찰관(APO)제도와 통합솔루션팀(IST), 지자체의 위기가정지원센터 운영현황 및 해외사례의 핵심내용을 조사하였다. 그 결과를 기반으로 자치경찰제 시행에 맞춰 자치경찰과 지방정부의 장점을 통합한 새로운 유형의 센터(가칭:가정보호전문센터)를 제안하였다. 가정보호전문센터 모델은 다음과 같다. 먼저, 센터 내의 센터장(경찰서·지자체의 가정폭력 업무 총괄 담당자 각 1명) 2명, 학대예방경찰관 1~2명, 통합사례관리사 1명, 상담원 1~2명을 배치한다. 이때 학대예방경찰관은 가정폭력 신고사건의 전수합동조사(초동조치의 적절성 여부 판단, 신변보호조치, 재발우려가정 지정 등), 상담사는 초기상담을 통해 신고 된 위기가정의 위급성 및 실태파악 및 재발우려가정 사후모니터링, 통합사례관리사는 학대예방경찰관과 상담사에게 공유받은 정보를 바탕으로 재발우려가정 등 고위험 가정을 포함한 가정을 방문·면담하고 전문가 개입 필요성을 점검 후 맞춤형 복지서비스를 지원하는 업무를 담당한다. 이 모델을 통해 경찰관은 가정폭력 사건에 적절한 초기대응 결정, 시·군·구의 통합사례관리자는 사례관리, 상담사는 피해자 상담에만 집중하는 등 각 분야의 전문가들이 그들의 전문성에 전력을 가함으로써 가정폭력 피해자들을 위한 효과적인 위기개입이 가능할 것이다. 그러나 아직 국내에는 자치경찰과 지자체 간 가정폭력 관련 정보를 공유할 연계시스템이 부재하다. 그러므로 업무의 신속성을 위해서는 가정보호전문센터에 전문인력을 배치함과 더불어 자치경찰의 112신고 정보와 지자체의 개인정보 및 사회복지서비스를 상호 공유해야 한다. 이렇듯 자치경찰제 도입과 함께 기관 간 연계시스템이 구축되고 가정보호전문센터가 신설된다면, 전국 가정폭력 피해자의 신속한 피해회복과 일상생활 복귀가 가능해질 것이다.

영문 초록

The city and provincial police agency will direct and supervise the local police affairs, such as domestic violence, under the control of the city and provincial police commission as municipal police system will be implemented based on Act on the Organization and Operation of National Police and Municipal Police from the July 2021. As the result, local governments and Municipal Police can protect and support victims by establishing effective solutions for families affected by domestic violence through mutual infrastructure. Firstly, this study examined the key contents of Anti-abuse Police Officer(APO) and Integrated Solution team(IST) of National Police Agency(NPA), Crisis Families Integrated Support Center(CFISC) of local government and overseas cases about domestic violence protection and victim supporting system. Secondly this study proposed new type of center integrated the advantages of NPA and local government as municipal police system established. The model of The Family Protection Specialized Center is as following below. Firstly, the center directors in charge of general domestic violence are deployed on this center to cover the police center and local government. Secondly, two APOs, 1-2 integrated case managers and 1-2 counselors are deployed. The main roles of APO are property evaluation of first action, personal protection and case designation of domestic violence reoccurrence. The counselors analyze the degree of urgency in reported crisis family, actual situations and post monitoring of domestic violence reoccurrence by initial counseling. The integrated case managers focus on supporting customized welfare services with visiting highly domestic violence reoccurrence home and evaluation of expert intervention after counseling by shared information by APO and Counsellor. More effective crisis intervention will be possible with promoting professionalism based on this approach, such as police officers focus on only appropriate initial response decisions, integrated case managers focus only on case management, and counselors focus on only counseling. However, connection systems is not organized between Municipal Police and local government. It is urgent not only to allocate professional personnel, but also to share information on 112 reports between the municipal police and personal information for fast work processing of The Family Protection Specialized Center , The damage recovery and returning to daily life of domestic violence victims across the country will be possible with organization of link system and home protection specialist center establishment according to municipal police system establishment.
