일제강점기 데릴사위 이야기의 문학법리학적 고찰

국문 초록

이 논문은 우리의 전통적인 혼인 형태 중 하나였던 데릴사위제도가 일제강점기 시대에 어떻게 문학적 주제로 형상화되었는지를 문학법리학적 관점에서 해석한 논문이다. 데릴사위제도는 우리의 전통 혼인 형태 중 하나로서, 일반적으로 아들이 없고 딸만 있는 집안에서 딸보다 나이가 많은 이성(異姓) 남성을 들여 딸이 혼인적령기에 이르면 혼인을 시켜준다는 전제 아래 남성의 노동력을 취하는 제도를 일컫는다. 그런데 이런 데릴사위제도는 일제강점기 조선 사회를 규율한 조선민사령의 외부에 놓이게 됨으로써 다양한 사회문제를 야기한 범죄 사건의 원인이 되었다. 이 논문에서는 먼저 일제강점기 데릴사위제도가 일제의 민사령과 관련하여 놓이게 된 근본적인 문제상황을 설명하고, 이후 당시 언론에 보도된 데릴사위 관련 기사들을 검토하여 그 심각성이 어느 정도였는지를 살펴보았으며, 마지막으로 이런 데릴사위 이야기가 당시 소설이나 희곡 및 연극 등, 제도화된 문학 양식에 어떻게 형상화되었는지를 살펴보았다. 그리하여 데릴사위제도는 1920년대부터 1940년대에 이르기까지 다양한 범죄의 원인이 되었음을 확인할 수 있었으며, 이런 사회적 현상을 반영하듯 1930년대 중반에 김유정의 ｢봄·봄｣과 남궁만의 ｢데릴사위｣ 같은 작품들이 데릴사위제도가 법의 사각지대에 놓이게 됨으로써 빚어지는 비극을 고발하고 있다는 것을 확인하였다. 또한 1940년 경성법률학교 학생회는 별도로 각색한 데릴사위 이야기를 모의재판극 형식으로 무대에 올려 공연하여 당시 일반시민들의 비상한 관심을 받는다. 이처럼 일제강점기 데릴사위제도는 다양한 문화적 장르를 통해 창작되었는데, 이것은 데릴사위 이야기가 식민지 조선에서 문제적인 삶의 방식이며, 법의 전향적인 보호를 요구하는 전형적인 문학법리학적 이야기로서 받아들여졌음을 보여준다.

영문 초록

This thesis interprets how “the custom of labor contract which promise to adapt a man into his wife’s family” (“Deril Sawi custom”), was represented as a literary theme during the Japanese colonial period from the perspective of literary jurisprudence. “The custom of labor contract which promise to adapt a man into his wife’s family” is a traditional form of a contract marriage: The man must work for his wife’ family until his future wife grow up to marriageable age, and he will be adopted as the husband for a woman of a family. This custom maintained until the 1920s and caused several crimes. Because it had been placed outside of the Korean Civil Laws in the Colonial Chosen(朝鮮民事令) that regulated the colonial Chosen during the Japanese colonial period. In this thesis, I first explained the fundamental situation this marriage custom in the Colonial Chosen. and then reviewed crime articles related to this custom reported in newspapers. Finally, I looked into how this custom was represented in the literary genres such as novels, plays. “Spring, spring” by Kim Yoo-jeong, “A man adapted as the husband for an heiress(Deril Sawi)” by Namgung-man, and a work whit the same title by Jo Jun-gyeong were produced and accused the legal neglect of this marriage contract system in the mid-1930s. And In 1940, the Gyeongseong Law School Student Association staged a story of this problematic marriage custom. The “Deril-Sawi” story was accepted as a typical narrative of literary jurisprudence that demanded the prospective protection of the law.
