지적측량적부심사제도의 발전방안에 관한 연구

국문 초록

토지의 경계는 소유권이 미치는 한계로서 매우 중요한 역할을 하며, 한정된 토지에 늘어나는 인구로 인해 토지소유권에 대한 여러 가지 문제가 발생되고 있다. 따라서 이로 인한 다양한 문제점으로 인해 국민들의 기대를 제대로 충족시켜주지 못하는 상황속에서 지적측량성과에 대한 불신의 벽을 허물 수 있는 제도개선이 요구되고 있다. 이 연구의 목적은 지적측량의 측량성과에 이의를 제기할 경우 지적측량의 분쟁해결을 위한 지적측량적 부심사의 이론적 고찰 및 현황을 파악하여 지적측량적부심사제도의 문제점을 살펴보고 개선사항을 도출하여 제도의 발전방안을 제시하는데 있다. 또한 이를 위해 경기도 지방지적위원회를 중심으로 2000년도부터 2007년까지의 지적측량적부심사가 진행된 자료를 토대로 현황 파악 및 문제점을 분석하였다. 지적측량적부심사의 개선방안으로는 지적측량적부심사 결과에 대하여 구속력을 부여하며, 지적측량적부심사에서 기각이나 각하된 사항에 대하여 비용을 징수하고 심사 및 절차를 강화하여야 할 것이다. 또한 청구인 및 지적측량수행자에게 의견을 제시할 기회를 부여, 지적측량적부심사를 DB로 구축하여 성과작성 양식의 표준화를 이루어야 한다. 또한 전문성이 강화된 지적위원회의 구성과 전담측량팀의 구성으로 지적측량성과에 대한 적부를 정확히 판단할 수 있다.

영문 초록

Land parcel boundary which is legally decided by the map boundary has very important role on the limits of ownership, the limitation of land parcen and growing populations make the ownership of land parcel which bring on a lot of problems. In the situation fo those do not make the desire of a nation people starve for building up a new system which resolve the results of cadastral surveying. The Purpose of this research is to consider a matter resolving a cadastral surveying in theory of the cadastral surveying testing system, to analyze the current status, to study the matters of the cadastral surveying testing system and make the solution which improve the system effectively when someone challenge the results of cadastral surveying in public. In this research analyze the results of the cadastral surveying testing system confine itself to Gyeong-Ki province and study the current status with data from 2000 to 2007. The result of this research are to entitle the results of cadastral surveying testing system, to levy taxes on facts which are rejected or dismissed and to improve judgement and procedure for developing the cadastral surveying testing system. And also, to grant a claimant and surveyors a fair chance of delivering oneself of an opinion, to establish DB of the cadastral surveying testing system for standardizing the format and to from a task force which make a discrimination between right and wrong exactly.
