일본의 지적조사 체계와 현황 분석에 관한 연구

국문 초록

본 연구는 반세기 전부터 지적조사를 실시하였고 우리나라에 근대적 지적제도를 도입시킨 일본의 지적조사 현황과 문제점을 구체적으로 분석하여, 향후 실시할 우리나라의 지적재조사사업에 시사점을 제시하는데 그 목적이 있다. 연구결과, 일본의 지적조사는 1951년 국토조사법의 제정으로 법적 근거를 가지고 실시되고 있으며, 2008년 말 현재, 전 국토의 48%의 부진한 진보율을 보이고 있다. 이처럼 지적조사가 부진한 이유에 대해 법제도적 관점, 실무적 관점, 의식적 관점으로 분석하였다. 즉, 조사실시자인 지자체의 담당인력의 부족, 재정 확보 문제, 의식 부족 문제, 지자체의 담당부서의 문제 그리고 이해관계자의 협력 부족(필계미지정의 발생)로 분석되었다. 전반적으로 주민과 행정이 지적조사의 필요성과 효과를 충분히 이해하지 못하고, 조사 착수의 전반적인 분위기 형성이 이루어지지 못했다. 일본의 지적조사를 현황 분석을 통한 시사점으로는 첫째, 국가적 차원에서 접근해야 할 지적재조사에 대한 정부의 적극적인 의지와 실천이 있어야 한다. 둘째, 안정된 재원조달 방안을 마련하여야 한다. 셋째, 민간 참여의 유도가 중요하다. 넷째, 경계분쟁해결제도를 마련해야 한다. 마지막으로 지적재조사의 필요성과 당위성에 대한 대국민 홍보를 통한 공감대 형이 필요하다.

영문 초록

This research aims to address directions and recommendations to current issues on needs for Renovation of Korean Cadastral Survey System. Since the modern Korean Cadastral System originated from the Japanese one which initiated 50years ago to process Cadastral Survey. However, after the contradictory concepts the Japan's Cadastral Survey System are discussed and criticized in this research and the solutions to concepts ares ought for the New Korea's Cadastral Survey System. According to the result of this research, Japan's Cadastral Survey operated on the basis of legal authority after they established and passed the National Land Survey Laws of Japan in 1951. However, in 2008, only 48% has been processed in the Cadastral Survey in Japan. It was analyzed at a legal system side, a practical side and a conscious side to the reason that results of a Cadastral survey are this low. The major reasons for delay are shortages of specialist to lead the Cadastral survey actions in the local government, financial issue, stake-holders' lack of cooperation, and awareness. In general, stake-holders including citizens and governments who did not recognize the importance of Cadastral Survey. Also, circumstances around Cadastral survey were not provoked and motivated enough with strong drivers. The recommendations for Renovation of Korean Cadastral Survey System are below from Japan's points at issus; First, the central government of Korea should recognize the importance of Cadastral Survey System renewal with administratively strong drivers and actions. Second, abundant and stable resources should be provided. Third, civic participation should be included. Fourth, boundary conflict issues should be dealt with mediation system. Finally, consensus should be evoked with necessity and obligation on the Renovation of Korean Cadastral Survey System by informing the public.
