국문 초록

해양레저스포츠 중 스킨스쿠버다이빙 관련 수상레저안전법과 낚시어선업법, 레저스포츠 진흥기본법(안) 등의 법적고찰을 통한 현실적인 문제점을 도출하여 이의 개선방안을 찾아보았다.스킨스쿠버다이빙 시 슈트와 부력조절기 착용과 수상레저안전법상 구명동의 미착용, 스킨스쿠버다이버의 이동수단과 낚시어선업법상의 불법 승선문제, 스킨스쿠버다이버의 전문인력 양성기관 지정 및 자격증 발급관련과 레저스포츠진흥기본법(안)상의 국가관리 주체 등의 문제점을 분석하여 이의 개선방안을 제시하고자 하였다.1. 스킨스쿠버다이버의 슈트, 부력조절기 착용이 수상레저안전법상 구명동의 미착용으로 간주되어 인명안전에 필요한 최소장비로 볼 수 있도록 행정ㆍ입법ㆍ사법부를 통해 구명동의 착용 면제방안과 다이빙슈트와 구명동의의 조항에 그 대체물로 간주하는 규정과 과태료 처분 시 유추해석으로 면제 받는 방안으로 들 수 있겠다. 2. 낚시어선업법은 “승선” 과 관련된 문제로 관련법 개정과 다이빙 레저선박의 제도화하는 방안을 들 수 있겠다.3. 레저스포츠 진흥기본법(안)은 “전문 인력 양성” 부분에서 양성기관과 자격증 발행 등의 사항을 대통령으로 정 하여 국가기관이 통제한다는 것에 문제가 있으며, 이는 관련법 재개정을 통하여 기존 교육단체의 인증을 받는 방식과 새로운 교육 단체의 브랜드를 인정하는 방법을 제시할 수 있다.

영문 초록

We have tried to find realistic problems and reform measures of skin scuba diving among Ocean leisure sports by considering laws of water surface leisure safety, fishing boat, and leisure sport promotion. During skin scuba diving, we would like to show reform measures by analysing the problems : wearing suit & buoyancy regulator, no wearing life jacket related to water surface leisure safety laws, illegal boat boarding relate to laws of fishing boat and moving means of skin scuba diving designating specialist training agency & issuing certificates, and management by government related to leisure sport promotion law. 1. Wearing just skin scuba diving suit and buoyant regulator is considered no wearing life jacket. So, there will be some exemption ways not to wear life jacket by administration, legislation, and justice department in order to regard those as minimum equipment for safety. Also, provision including articles about considering substitution instead of diving suit and life suit and analogical interpretation when people get fine will be the other way of exemption. 2. There are also plans by revision of related laws about ship boarding of fishing boat law and institutionalization of diving leisure ship. 3. There are some problems of leisure sport promotion law in that government agency controls training institutions and issuing certificates by a presidential degree in the specialist training part. This can be solved by existing education center s confirmation through the revision of the related law and by approving new training center brand.
