국문 초록

이 논문에서는 2006년 설립된 <한국스포츠중재위원회(Korea Sports Arbitration Committee:KSAC)>의 설립 경위와 활동내용, 그리고 개선방안에 대하여 살펴보고자 한다. 스포츠경기를 운영하면서 선수와 경기단체 및 심판간의 분쟁이 발생하게 된다. 국제경기대회의 출전정지 등의 처분에 불복하는 경우도 있다. 선수의 자격, 심판의 판정, 도핑 등에 대한 분쟁은 물론 법령에 의한 법률상의 쟁송으로 해결할 수 있지만, 시간적 상당한 손실이 따르고 경제적인 부담도 대단히 크다.따라서 스포츠분쟁의 신속한 해결을 위한 ADR제도의 활용이 요구되었고, 스포츠분쟁해결을 위한 전문기구의 설치가 필요하게 되었다.스포츠분야의 분쟁해결은 다른 분야보다도 신속성과 전문성이 요구된다. 한국스포츠중재위원회가 출범한지 불과 2년도 채 되지 못했기 때문에 아직 활동이 미흡한 실정이다. 이 분야의 특수성을 감안하여 일반적인 당사자 합의에 의한 중재제도의 한계를 극복할 수 있는 제도적인 보완이 시급히 요청되고 있다. 한국스포츠중재위원회의 위상을 높이고, 스포츠분쟁해결의 활성화를 위해서는 법적인 근거를 명확히 규정할 필요가 있다는 점을 강조하게 된다. <국민체육기본법>을 제정하여 스포츠기본권에 관한 사항, 정부와 지방자치단체의 책무, 스포츠산업진흥과 스포츠육성을 위한 기본지침, 스포츠와 국제협력 등을 규율하면서 스포츠분쟁해결을 위한 기구의 설치근거를 규정하는 것이 필요하다고 본다.

영문 초록

In this paper, I am going to watch it for establishment process, activities and improvement of the Korea Sports Arbitration Committee:KSAC, which was established in 2006. Disputes are raised between players and sports teams(federations) or referee, while playing the sports games. Threre could be a lot of disputes for a qualification of a player, judgment call, doping. Of course it can be solved by legal institutions , for example copurts, but economic loss and burden are terrible. Therefore, inflection of an ADR system for quick resolution of sports dispute was demanded, and the establishment of specialty mechanism for sports dispute solution was necessary. Supplement of the system that activity is still the fact that is not enough and takes specialty of this field into consideration because it was not able to be still it as for the dispute solution of the field of sports. It can get over a limit of an arbitration system by a general person concerned agreement is requested for suddenly. The position of the Korea Sports Arbitration Committee should be elevated higher socially to emphasize a point that it is necessary to prescribe legal grounds for activation of sports dispute solution definitely. I would like to propose the establishmnet of Basic Law for Sports, in which should be comprised establishment of an appliance for sports dispute solution while rules do a duty of a matter about the basic sports right, the government and a local government, a basic guidelines on future policy for thhe promotion of sports industry and international cooperation.
