국문 초록

현대사회에서 스포츠는 인간의 삶을 다양하고 풍요롭게 만듦으로써 인간생활의 한 부분이 되고 있다. 거의 날마다 열리는 스포츠경기와 건강을 유지하고 활기찬 삶을 위한 일상생활에서의 운동은 이제 삶의 방식이 되고 있다. 정보통신기술의 발달은 스포츠의 국제화를 급속도로 촉진하고 있으며, 스포츠산업의 발전은 스포츠의 경제적 가치를 제고하면서 스포츠의 발전을 가속시키고 있다. 이렇게 스포츠는 단순히 정신과 육체의 단련 및 연대의 의미를 넘어서 경제적 가치로까지 확대되고 있다. 스포츠가 국가와 사회에 미치는 영향이 커지고 가치가 확대되면서, 이제 스포츠는 헌법차원에서 다루어야 할 대상이 되고 있다. 국가는 스포츠의 육성과 발전을 위하여 관련법제를 구축하고 있으며, 스포츠의 육성과 진흥을 위한 각 종의 정책을 수립하여 추진하고 있다. 또한 스포츠는 국제경기를 통하여 국가경쟁력의 상징이 되기도 하고, 국가 간에는 친선과 협력을 위한 도구로 스포츠를 활용하기도 한다. 그리고 보는 대상에서 스스로 즐기는 대상으로 스포츠가 변천하면서 스포츠의 생활화 내지 대중화가 급속하게 진전되었고, 이런 상황은 스포츠의 발전을 배가하는 결과를 가져오고 있다. 이렇게 스포츠가 현대사회에서 차지하는 비중이 커지고 있는 상황은 우리나라도 마찬가지이다. 더욱이 우리나라는 1980년 이후 여러 차례에 걸쳐 국제스포츠경기대회를 개최하면서 스포츠의 시설이 확충되고 스포츠를 상시로 즐기는 국민의 수요가 증가하였다. 물론 이런 현상에도 불구하고 스포츠분야에서는 여전히 선진 여러 국가에 비하여 부족한 부분이 많다. 그렇지만 우리 나름대로 스포츠에 관한 법과 제도를 구축하고 있으며, 문화체육관광부를 중심으로 한 국가조직은 스포츠의 육성과 발전에 기여하고 있다. 스포츠의 중요성이 커진 것에 대하여 여러 국가는 헌법상의 기본권 내지 국가가 지향해야 할 규정으로 스포츠를 도입하였다. 그리스를 위시하여 스페인이나 포르투갈은 스포츠를 기본권 차원에서 헌법에 명문화하여 보장하고 있다. 우리나라는 스포츠권에 대하여 그동안 헌법해석으로 그 보장의 강도를 조절해 왔다. 그렇지만 헌법상의 기본권으로 명문화된 것과 아직 도입되지 못한 기본권과의 차이는 분명하다. 그렇기 때문에 이번 헌법개정에서 스포츠기본권을 명문화하는 것은 중요한 작업이면서도 현대사회의 요청이라 할 수 있다.

영문 초록

Sport plays an important role as a vital factor in human life in modern society. People purchase sports commodities and sports-related news are to be reached through everyday media. We watch sports, and do sports for a decent body. This is one of the reasons why human being is also called Homo Sportivus , human who practices sports. We are living in a world unimaginable without sports. Considering the infinite values that sports provide, it is evident that it should be included in the Constitution. Related system of laws are being established by the state, and government policies are made and implemented to enhance the development of sports. At the international level, sports represents the capacity and competitiveness of a nation and at the same time, acts as a useful means to foster friendly relations among nations. Furthermore, becoming as a part of our daily life, its development is enhanced rapidly. Korea saw a great development in sports as well, as the nation held several international rally for sports. However, despite the increasing demand for daily sports, many parts have the space for improvement compared with other developed nations. The government built an administrative system with the Ministry of Culture, Sports and Tourism on the top, and established several organizations like the Korea Sports Council, the Korean Olympic Committee, Seoul Olympics Sports Promotion Foundation, and the Korean Council of Sports for All. However, due to the lack of related laws and institutional support, the effect is not as maximized as expected. Although sport is being guaranteed as a basic right and is supported by the government at the constitutional level, it calls for improvement and construction of related laws and institutional support. Other developed nations and our previous experiences in holding and participating in international sports rallies could give a lesson to recognize the importance of sports from a new perspective. The reason many states have accepted and started guaranteeing sport as a basic right from the late 20th century is because of the recognition that health of people provides the base for national competitiveness, in the aging society. Adapting to the change of era, we should guarantee and upgrade the status of sport through constitutional amendment from the perspective that the health of people is the most important factor for the future of our nation. May sports become the basic right in our Constitution through the amendment.
