규제의 적정성 유지를 위한 법적논의 - 대형마트 의무휴업일 규제를 중심으로

국문 초록

규제의 적정성 확보는 규제가 법령을 준수하는 가운데 목적 달성에 효과적이며, 이행 과정에서 과도하게 국민의 권리를 제약하거나 의무를 부담하지 않도록 하는 것을의미한다. 규제 도입단계에서의 적정성 확보를 위해 규제영향평가 등이 시행되며, 규제 시행단계에서의 적정성은 규제의 항상성(恒常性)과 관련된 만큼 규제 도입 이후에도 주기적인 검토가 이루어져야 한다. 규제 도입 이후의 규제 적정성 확보를 위해 규제일몰제가 활용되며, 규제의 효력을 상실시키는 ‘효력상실형 일몰규제’와 규제의 재검토기한을 설정해 일정 기간 후, 규제의 재검토의무를 부과하는 ‘재검토형 일몰규제’ 가있다. 규제에 대한 재검토 의무가 부과되더라도 재검토 과정에서 광범위한 이해관계자의 참여가 이루어져야 형식적 검토의 관행을 타파하며, 규제포획 등의 부작용을 막을수 있다. 대형마트 관련 정책은 2010년 이전까지 대형마트의 지원에 중점을 두었지만 대형마트의 지속적인 성장과 소상공인의 경영 어려움으로 인해 대형마트의 출제 규제뿐만 아니라 영업시간 및 의무휴업일 지정 등의 영업 규제가 도입되었다. 대형마트의 출점 규제에 대해 ｢유통산업발전법｣에 효력종료일이 규정된 반면 국민의 생활에 광범위한 영향을 미치는 대형마트 영업규제에 대한 일몰규정은 부재하다. 대형마트 의무휴업 규제의 적정성을 지속적으로 평가하기 위해 일몰조항이 도입되어야 한다. 일몰조항의 도입이 어렵다면 지방자치단체장에게 의무휴업일 지정에 대한 재량권을 부여해 규제 집행의 유연성을 확보할 필요가 있다.

영문 초록

This paper explores the concept of evaluating the appropriateness of regulations, which means assessing whether they effectively achieve their goals while adapting to societal changes. We can consider regulatory appropriateness in two main phases: when regulations are first introduced and when they are implemented. At the introduction stage, tools like regulatory impact assessments help ensure that regulations are suitable. During the implementation stage, regular reviews are crucial to keep them relevant. One way to achieve this is by using sunset clauses, which either terminate a regulation after a certain period or require it to be reviewed. It is important to involve a diverse group of stakeholders in these reviews to prevent any single group from having too much influence. Policies for large retail stores initially aimed to support their growth, but as these stores expanded, new regulations were introduced to address challenges faced by small businesses, such as limits on operating hours and mandatory closure days. Although the Distribution Industry Development Act includes sunset provisions for the registration of large retail stores, it lacks such clauses for rules affecting how these stores operate, which significantly impact our lives. This paper suggests adding sunset clauses for mandatory closure rules so they can be regularly reviewed and improved. Alternatively, allowing local governments more flexibility in setting closure days could make these rules more adaptable.
