한국의 인신매매 대응 현황과 과제

국문 초록

인신매매는 구시대의 범죄가 아니라, 현재까지도 강제노동, 성착취, 장기적출 등 다양한 형태로 나타나고 있는 글로벌한 문제 이다. 최근 발표된 UN 보고서는 인신매매 범죄가 코로나 이후 증가 추세에 있다고 강조했다(Reuters, 2024). 다문화사회 진입 을 목전에 둔 우리나라도 외국인 노동자 대상 강제노동은 물론, 여성ㆍ장애인 등 취약계층을 노린 인신매매 범죄가 여전히 자행 되고 있다. 이에 이 연구는 한국의 최신 인신매매 대응 현황을 분석해보고, 법적ㆍ정책적 개선 방안을 강구해보았다. 국제 기준 과 비교해 한국의 인신매매 정의와 법적 체계를 분석하고, 미국 국무부의 ‘2023년도ㆍ2024년도 인신매매보고서(Trafficking in Persons Report)’ 내용을 바탕으로 한국의 대응 성과와 함께 보완해야 할 부분을 추출했다. 그 결과, 2023년 시행된 ‘제1차 인 신매매등 방지 정부 종합계획’은 피해자 지원 강화 등 국내 인신매매 대응체계에 있어 중대 전환점이 되었으나, 법적 정의의 한 계ㆍ비(非)성적 착취 피해자에 대한 지원 부족ㆍ처벌의 미약성 등이 한계로 나타났다. 또한, 인신매매등 범죄 대응 전반에서 남 성 노동착취 피해자 등 사각지대 집단에 대한 조사와 응급조치가 미비한 점도 드러났다. 결국, 한국에서 인신매매 피해자를 조 기에 식별하고 착취유형에 따른 지원체계를 구축하며, 나아가 관련 범죄를 근절하기 위해서는 국제 기준에 부합하는 법적 정의 확대, 피해자 중심의 통합적 지원 체계 강화, 법 집행의 실효성 제고 등을 법적ㆍ정책적으로 시급히 추진해나가야 할 것이다.

영문 초록

Human trafficking is not an old-fashioned crime, but a global problem that still appears in various forms such as forced labor, sexual exploitation, and organ harvesting. A recently released UN report emphasized that human trafficking crimes are on the rise after COVID-19 (Reuter, 2024). In Korea, which is on the verge of entering a multicultural society, human trafficking crimes targeting vulnerable groups such as women and the disabled as well as forced labor for foreign workers are still committed. Therefore, this study analyzed the latest status of human trafficking responses in Korea and devised legal and policy improvement measures. Compared to international standards, Korea's definition and legal system of human trafficking were analyzed, and based on the contents of the “2023 and 2024 Trafficking in Persons Report” of the US Department of State, parts to be supplemented along with Korea's response achievements were extracted. As a result, the “First Government Comprehensive Plan to Prevent Human Trafficking, which was implemented in 2023” became a major turning point in the domestic human trafficking response system, such as strengthening support for victims, but the limitations of legal justice, lack of support for victims of non-sexual exploitation, and weak punishment were found to be limited. In addition, it was revealed that investigations and emergency measures on blind spot groups such as male labor exploitation victims were insufficient in overall crime responses such as human trafficking. In the end, in order to identify victims of human trafficking early in Korea, establish a support system according to the type of exploitation, and eradicate related crimes, it is necessary to urgently promote legal and policy expansion of legal justice that meets international standards, strengthen an integrated support system centered on victims, and improve the effectiveness of law enforcement.
