국문 초록

본고는 2천여년 동안 동아시아를 지배한 유교의 두 번째 거장인 맹자의 철학사상 중,특히 정치적 의미가 깊고 역사적 파장도 컸던 포군방벌론을 법학적 관점에서 다양한각도로 조망하고자 한다. 물론 정치학이나 철학에서 접근한 연구가 있지만, 본고는 중문학을 부전공한 법학자의 관점에서 인문학과 법규범학을 함께 아울러 통관하는 색다른 의미가 있을 것이다. 먼저 맹자 사상의 핵심인 왕도인정의 기본 전제로서 국가의 3요소와 군주의 인민부모 자격에 대해 간략히 소개하고, 이어 인정의 기본 4단계를 정리한다. 그러한 일반론의 바탕 위에서, 저항권과 역성혁명으로 상징되는 맹자의 대표적정치사상인 포군방벌론을 주된 본론으로 탐구하는데, 주요 내용은 다음과 같다. 첫째, 인민이 존귀하고 군주가 가볍다는 설; 둘째, 신하의 도리와 저항권의 종류; 셋째, 易位의 人性 心理적 근거; 넷째, 다산 정약용의 충신효자 怨情론; 다섯째, 易位의 정당성 근거로서 포군방벌의 본질적 제한; 여섯째, 포군방벌로서 정의로운 전쟁(義戰論);일곱째, 포군방벌과 역성혁명의 역사적 논란; 여덟째, 역사적 평가를 차례로 기술한다. 국가의 존재근거와 군주의 존립기반은 동서고금을 통틀어 인민이고, 따라서 군주는 天賦든 神託이든 결국 인민의 부모로서 養民과 保民의 막중한 책임을 져야 한다. 이것이왕도인정의 핵심이다. 군주로서 의로운 왕도를 크게 벗어나, 군주의 존립기반인 인민의願望을 무시하고 民怨을 야기하여 민심을 잃으면, 권력의 기반이 무너져 왕권과 국가자체도 붕괴함은 인간사회의 역사진실이다. 권력에 등용되길 바라는 지식인으로서 왕의 면전에서 권력의 존립과 기반붕괴의 가능성 및 조건까지 적나라하게 직접 말하기가결코 쉽지는 않을 텐데, 약육강식의 겸병전쟁으로 유능한 현자를 구하는 제후들의 갈망에 부응하여 제자백가의 유세가 종횡무진으로 난무하던 혼돈의 戰國시대에, 맹자는 성선의 기반 위에서 仁政의 구체적 청사진을 제시하면서, 특유의 부동심과 호연지기라는대장부의 기상을 떨쳐, 정권의 현실적 최악 시나리오까지 거리낌 없이 펼쳐 보임으로써, 도덕의 양면성을 균형 있게 인식시키며 왕도정치의 권선징악을 완성한 것이다. 일찍이 명태조 주원장도 깊이 공감했듯이, 맹자의 포군방벌론은 결코 국가전복과 군주탄핵을 겨눈 불온선동사상이 아니라, 군주의 정치적 성공과 인민의 행복한 삶을 ‘誠心’으로 기리는 자비로운 거룩한 축원이라는 진실을, 현재와 미래의 모든 권력자들과 인민들이 꼭 유념하고 명심할 일이다. 졸고가 맹자 철학사상의 연구를 다양하고 풍부하게 하는 한 빛깔을 보태길 바라며,앞으로 관심있는 훌륭한 학자들이 더욱 넓고 깊은 동서양 비교연구를 계속하길 기대한다.

영문 초록

This paper would take general view of Mencius theory of the purge of tyrantfrom the jurisprudential angles. First of all, it introduces briefly the threerequisites for nation & the just kingship as the parent of the people which arepreconditions of kingly way of benevolent government, the core of Mencius philosophy. Next it describes the basic four steps of the kingly benevolentgovernment. On these bases, the main topics of Mencius theory of purge oftyrant will be developed, and main contents are as follows. First, Mencius theory that the people are high and noble, and king isunimportant; second, the right way of rear vassal and kinds of the right ofresistance, for examples negative & positive resistance; third, ethological &psychological ground of the change of kingship; forth, Dasan(茶山) Jeong,Yak-young s opinion on the resentment loyal subjects & good sons against king;fifth, the substantial restriction on purge of tyrant for just change of kingship;sixth, just war as the purge of tyrant; seventh, historical discussions of the purgeof tyrant & the revolution changing Royal Family; eighth & finally, historicalcomments. The existence of nation & subsistence of king are based on the people, so theking as the parent or guardian of the people should shoulder high & heavyresponsibility for the fostering & safeguard of the people. This is the core ofMencius thought on the kingly way of benevolent government. If king is notalike king and override the wishes of the people, he shall lose the mind(support)of the people and consequently lose the kingship & power. It is historical truthacross the ages and countries of the world. On the basis of treatise of good human nature, Mencius presented a concreteblueprint with hopes for the kingly way of benevolent government as well as theworst realistic possibility of revolution scenarios that the bad king-power shallbring about on itself in the worst case. Mencius persuading the good anddissuading the wicked is for the sake of the coexistence & co-prosperity betweenthe king & the people. Mencius political philosophy is never a threatening idea[a disquieting thought]aiming for instigating the people to the overthrow of the government & the change of kingship, on the contrary is a great compassionate & saint blessing towish with his whole heart the political success of king & the greatest peacefulhappiness of the greatest people. It is an undeniable truth that all the present &future presidents & peoples should keep in mind. In conclusion, the author hopes that this paper add a color to variety &abundance of the studies on Mencius philosophy, so that the young mayaccomplish further more broad & deep study on Mencius theory of purge oftyrant from the jurisprudential viewpoint, especially comparative study betweenoriental & occidental.
