부패와의 전쟁: EU 반부패 패키지 도입과 시사점

국문 초록

상대적으로 반부패 지수가 높은 EU는 기존의 반부패 정책의 존재에도 불구하고 2011년 반부패 패키지를 도입하였다. 이에 본 논문은 EU의 반부패 패키지 도입의 필요성을 고찰하고 이에 대한 시사점을 제시하고자 한다. EU는 2011년 반부패 패키지 도입 이전에 이미 EU 차원 및 국제적 차원의 다양한 반부패 정책을 도입하였다. 그러나 EU 회원국의 개별 이해관계에 대한 고려와 EU와 회원국 사이의 권한 문제 등으로 개별 회원국의 EU 및 국제 반부패 정책의 비준 및 이행은 성공적으로 시행되지 않았다. 이 와 더불어 2004년 중동부 유럽의 국가들이 신규 회원국으로 가입하고, 최근에 금융 위기 등을 거치면서 EU 시민들은 여전히 EU 및 자국에 부패가 만연해 있다고 인식한다. 이에 EU는 반부패 정책이 효과적으로 시행되고 있지 않는 가장 중요한 이유가 개별 회원국의 정치적 결단이 부족하다고 보고 이에 대한 보완책으로 2011 EU 반부패 패키 지를 도입한다. 반부패 패키지의 가장 핵심적인 사항은 EU 차원의 반부패 리포트 제도의 도입이다. 이전에 제도의 불필요한 중복 가능성을 이유로 OECD 및 GRECO의 모니터링 제도를 활용하였으나 이는 개별 회원국별로 상이한 부패 형태, 정책 집행의 문제 점 및 비준, 이행 문제를 정확히 파악하기 어려웠다. 부패 리포트는 이러한 문제점을 해결하는데 있어 기존의 다른 어떤 정책보다 효과적일 것으로 기대된다. EU의 반부패 패키지 도입을 통해 EU보다 상대적으로 부패 지수가 높은 한국도 보다 효과적인 반부패 정책의 시행을 위해 정부 및 시민사회의 노력이 요구되어 진다.

영문 초록

In 2011 the EU as highly ranked in the Corruption Perception Index introduced ‘anti-Corruption Package’ even if it had already adopted several anti-Corruption policies. From this perspective, this paper aims at examining the reasons and necessity for the EU’s introduction of new policy, ‘anti-Corruption Package’ and its implications. Before 2011, the EU has adopted various anti-corruption policies either established by the EU itself or internationally agreed. However, the ratification and implementation of these policies are uneven among member states mainly because of the conflicts of national interests and the problem of competence between the EU and member states. In addition, EU enlargement towards Central and Eastern European countries in 2004 and the financial crisis in Europe makes the EU and its citizens still feel prevalent of corruption in the EU and their member states. The EU recognises that the lack of political commitments on anti-corruption by member states has been the main reason why the EU’s anti-corruption policies did not work successfully. As a response to that problem and also one of the main features of anti-Corruption Package, the EU introduced ‘anti-Corruption Report’ which monitors and assesses members’ ratification, implementation and/or enforcements of anti-corruption policies as well as diagnoses each member’s problem for corruption. ‘anti-Corruption Report’, therefore, is expected to be more effective than any other policy options the EU has adopted so far. From the analysis of the development of the EU’s anti-corruption policies, it is time for the government and civil society in Korea to develop effective anti-corruption policies.
