사법부의 독립성 제고와 합리적 사법작용

국문 초록

이 글은 정치부분의 민주화에도 불구하고 여전히 폐쇄적 관료체제를 벗어나지 못하고 있는 우리 사법부의 문제점들을 지적하고 사법의 객관성을 도모하기 위하여 그의 독립성·공정성을 확보하고 나아가 오늘날 새로운 지향으로 부과되고 있는 사법의 책무성·민주성을 구현하기 위한 사법개혁의 과제들을 제시함을 목적으로 하였다. 사법의 독립성이라는 헌법상의 명제에 공정성과 민주성의 요청을 부가하고 이러한 목적을 달성함에 최적으로 구성되는 사법체계를 구상해 본 것이다. 보기 드물게 강력한 엘리트주의적, 계층적 구조를 가지고 있는 우리 사법부는 바로 그 때문에 구체적인 법원 혹은 법관의 외형적 독립은 보장되고 있지만, 모든 법원과 법관을 하나의 체제 속에서 통할하는 굳건한 중심-대법원장과 그 보좌기관으로서의 법원행정처-의 영향력은 이런 외형적 독립성의 의미를 거의 무위의 것으로 희석시켜 버리고 만다. 더구나 시민적 참여 혹은 감시로부터 완전히 자유로왔던 폐쇄적 의사결정구조는 사법부를 정치권력 혹은 경제권력에 취약한 것으로 만들 뿐 아니라 사법작용 그 자체에 대한 국민 일반의 불신을 야기하게 되어 법치의 실패는 물론 남상소로 인한 법원운영의 비경제성까지도 야기하고 있는 실정이다. 이에 이 글은 계층적 인사제도의 철폐 및 법조일원화의 실현, 고등법원과 지방법원인사의 분리, 하급심의 강화, 배심제도의 도입 및 판결문의 완전한 공개, 법원행정처의 해체 및 법원과 법관 등 사법자원의 양적 확대를 그 대안으로 제시하였다.

영문 초록

At the core of the rule of law, lies the independence of the judiciary, which has been the main target of the judicial reform movement in Korean civil society. Since the democratization of 1987, Korean judiciary hasapparently acquired relative freedom from direct intervention of the political poers. It is, however, pointed out that the hierachal structure of the judiciary, where most powers are concentrated on the Chief Justice, has let most judges very vulnerable to the pressure of the senoir and/or higher judges, which means the independence of the judiciary can be infringed indirectly. Most judges, who are eager for promotion to higher position in more that 13 steps from the 'associate judge in left bench' to the Chief Justice, can't help adapting themselves to the slightest pressure of the senior judges who have the authority over personnel affair. The power holders may contact only with the heads of the courts of each jurisdiction in order to make some influence on pending trials. That is the reason why the hierarchal structure has been the main target of the judicial reform demands of the civil society. The National Court Administration has been the main source of the unprecedentedly strong power of the Chief Justice, who has substantially politicalized the Korean judiciary. The Administration, which can control most judges with the authorities over personnel affairs of all the judges, and planning and budgeting, should be dramatically deconstructed into locally divided small branches of each higher courts. The jury system has been one of the most frequently demanded theme in Korean civil society for the democratization of the judiciary, where so much closed decision making conventions based on elitist and bureaucratic structure have been prevailed. With some changed in jurisdictions of the district courts and appellate procedures, it would make some solid steps toward making the judiciary more accountable to civil society. Securing people's easy access to the court records including the sentencings and/or the rulings is another requisite to more accountable judiciary. It should be reminded that the problems of privacy of the parties can't be an excuse for closing the court records from the public's eyes. Increase of judicial facilities including the judges is the most urgent task. Comparing with any other developed countries, Korean Judiciary is one of the smallest in either size(5.4 judges in 100,000 inhabitants) and budget(19？？ per capita), which has substantially reduced people's right to access to justice.
