정부형태 개헌의 필요성과 방향

국문 초록

정치권을 중심으로 최근 개헌논의가 다시 고개를 들고 있다. 국회의장의 자문기구인 헌법 연구자문 위원회에서 수개월 전에 개헌과 관련해 이원정부제또는 4년 중임의 정ㆍ부통령제 권력구조 개편안을 제시했고, 그 직후 이명박 대통령도 개헌의 범위를 권력구조 개편으로 한정해 개헌논의를 시작하자는 소위 ‘제한적 개헌론’을 언급해 정치권의 개헌 논의에 불을 지폈다. 필자는 국가의 최고법인 헌법의 개정에 관한 논의는 신중에 신중을 기해야 하고, 만약에 국민들이 원해서 개헌을 한다면 정부형태 등 통치구조보다는 시대의 변화에 부응하는 방향에서 기본권편의 개정에 초점을 두는 것이 바람직하다고 믿는다. 국민들은 배제된 채, 정치인들이나 정당의 이해관계에 따라 개헌 논의가 정부형태 개정에 집중되어서는 곤란하다. 언제까지는 개헌을 완료해야 한다는 식으로 개헌의 시간표를 미리 짜놓는 듯한 주장에도 찬성할 수 없다. 이 자체가 국민보다는 정치권의 정치일정에 따라 밀어붙이기식의 개헌으로 나아갈 수 있는 위험성을 지니고 있기 때문이다. 본 연구는 우리 헌법상 정부형태 조항들에 대한 개헌의 필요성은 있는지, 또 정부형태 조항들을 개정해야 한다면 그 바람직한 개헌의 방향은 어떠해야 하는지를 규명함을 연구의 목적으로 한다. 이를 위해 다음에서는, 우리나라에서의 대통령제 정부형태의 채택 역사를 우선 알아본다. 그리고 의원내각제나 이원정부제 정부형태 채택시 예상되는 문제점을 짚어본 후, 정부형태 개헌의 필요성을 대통령에의 권력집중과 측근비리 등의 부정부패의 해결, 대통령과 국회의 극한적 대결의 해결, 지역주의의 해결과 선거구제 개혁 및 부통령제 도입을 중심으로 살펴본다. 끝으로 대통령제 임기조항 개헌의 문제에 대해서도 알아본다.

영문 초록

Recently, the constitutional revision is a hot issue among the politicians. Several months ago, the Constitutional Research and Advisory Committee under the Chairman of the Korean Congress proposed the Double Executive System and the Presidential System in which the presidential tenure is 4 years and the President can be once re-elected. Right after that, President Myong-bak Lee mentioned 'Restrictive Constitutional Revision' which restricted the sphere of the constitutional revision only to the governmental structure. I believe the revision of the constitutional law, the highest law of the land, should be made as carefully as possible and, if the Korean people would want the constitutional revision, it should be focused not on the governmental structure but on the constitutional rights because the current provisions on the constitutional rights have become too old-fashioned in the rapidly changing society. This paper aims at exploring on whether there is any compelling necessity for the constitutional revision on the governmental form and, if so, what would be the desirable direction for that. To achieve the aim, this paper looks over the constitutional history on how the Korean Constitution adopted the Presidential System in the First Constitution and how it has been modified it until the current Constitution. Then it will examine the problems which would be caused by the adoption of the Parliamentary System and the Double Executive System in Korean Constitution. In addition, this paper will explore on whether there is any necessity for the constitutional revision on the governmental form in terms of the excessive concentration of the power to the President, the extreme confrontation between the President and the Korean Congress, and the conquest of the regionalism in Korean politics. Finally, it will examine the issue of the constitutional revision on the presidential tenure provision as well.
