국문 초록
먼저 집회 및 시위에 관한 법률 제5조 제1항 제1호가 그 누구라도 헌법재판소의 결정에 의해 위헌으로 해산된 정당의 정강이나 당헌의 내용을 주장하기 위한 집회나 시위를 개최할 수 없다는 것을 뜻한다는 것과 동법 제5조 제1항 제2호가 통상적으로 수인할 수 없는 직접적인 위험을 초래할 것이 명백한 집회나 시위를 뜻한다는 것을 건전한 일반상식을 가진 자라면 충분히 예측할 수 있으므로, 이 규정들은 모두 명확성의 원칙에 반하지 않는 합헌적 규정이라고 할 것이다. 그리고 관할경찰관서장이 공공의 안녕 질서에 직접적인 위험이 발생할 것이 명백한 집회나 시위일 때 비로소 집회 및 시위에 관한 법률 제5조 제1항 제2호를 적용하여 금지시킬 수 있다는 점과 동법 제8조 제4항과 동법 제9조 제1항에 의해 동법 제5조 제1항 제2호가 사전허가제로 변질되지 않도록 방지하고 있다는 점에서 동법 제5조 제1항 제2호는 헌법상 금지되는 사전허가제가 아니라고 할 것이다. 또한 공공의 안녕 질서를 유지하여 국민의 기본권을 보호하기 위한 집회 및 시위에 관한 법률 제5조 제1항 제2호의 입법 목적은 정당하고, 동 규정에서 공공의 안녕 질서를 직접적으로 위협할 것이 명백한 집회나 시위의 개최를 금지하는 것은 이러한 입법 목적을 실현할 수 있게 기여하므로, 수단의 적합성 원칙에 합치된다. 그리고 동 규정에 해당하는 집회나 시위를 사전에 금지시켜 공공의 안녕 질서와 국민의 기본권이 크게 훼손되는 것을 보호하려는 것을 지나치게 과도한 제한으로 볼 수 없고, 관할경찰관서장이 동 규정에 해당하지 않는 집회나 시위를 위법하게 금지했을 때에는 법원의 소송을 통해 구제를 받을 수 있을 것이므로, 최소 침해의 원칙에 반하지 않는다. 따라서 동 규정에 의해 달성하려는 공공의 안녕 질서의 유지와 국민의 기본권 보호라는 법익은 동 규정에 의해 침해되는 집회의 자유라는 법익보다 크다고 할 것이므로, 법익 균형의 원칙에 반하지 않는다고 생각한다. 이러한 사유로 헌법재판소가 동 규정에 대해 합헌이라고 판시한 2010년 4월 29일의 2008헌바118결정은 타당하다. 이밖에 집회 및 시위에 관한 법률 제5조 제1항 제2호는 옥내집회에도 적용된다고 할 것이며, 관할경찰관서장이 과거에 동 규정에 해당되는 집회나 시위를 개최한 전력이 있는 자들에게 이를 이유로 현재에 개최하려는 집회나 시위를 금지할 수는 없다고 할 것이다.
영문 초록
First of all, since any person with common sense can sufficiently predict that Number 1, Clause 1, Article 5 of law on assembly and demonstration means that no person is allowed to hold assembly or demonstration to advocate the platform or constitution of a political party dissolved for violating the Constitution by the decision of the Constitutional Court and that Number 2, Clause 1, Article 5 of the same law means the assembly or demonstration which is clearly likely to cause a direct risk not normally acceptable, those provisions should be deemed constitutional not violating the void for vagueness doctrine. And, considering that the chief jurisdiction police officer can only prohibit an assembly or demonstration which is clearly likely to cause a direct risk to the public peace and order by applying Number 2, Clause 1, Article 5 of law on assembly and demonstration and also that Clause 4, Article 8 and Clause 1, Article 9 of the same law prevents the above-mentioned Number 2, Clause 1, Article 5 from being converted to a prior permission system, the Number 2, Clause 1, Article 5 should be deemed not a prior permission system prohibited by the Constitution. Also, since the legislative purpose of Number 2, Clause 1, Article 5 of law on assembly and demonstration to protect basic rights of the citizens by maintaining the public peace and order is legitimate and since the same provision's prohibition of assembly or demonstration which is clearly likely to cause a direct risk to the public peace and order contributes to achieving such legislative purpose, that provision conforms to the principle of suitability of means. And, since protecting the public peace and order and basic rights of the citizens from serious damage by prohibiting in advance the assembly or demonstration falling under the above-mentioned provision can not be deemed as excessive restriction and since one can file a lawsuit in a court of law for relief measures if the chief jurisdiction police officer unlawfully prohibits the assembly or demonstration not falling under the same provision, that provision does not violate the principle of minimum infringement either. Therefore, as the benefit of maintaining the public peace and order and protecting basic rights of the citizens to be achieved by the above-mentioned provision exceeds the benefit of freedom of assembly harmed by the same provision, the principle of the balance of benefit and protection of the law is not violated, according to the author. For such reasons, the Constitutional Court's 2008Hunba118 decision of April 29, 2010 holding the same provision constitutional is correct. In addition, Number 2, Clause 1, Article 5 of law on assembly and demonstration should be deemed to apply to indoor assemblies too and the chief jurisdiction police officer should not be allowed to prohibit those having ever held an assembly or demonstration falling under that provision from holding an assembly or demonstration in the present by reason of the past assembly or demonstration.
