국문 초록

헌법총강의 개정은 필요한가? 헌법의 기본원리 부분에 해당하는 헌법총강의 내용을 개정할 수는 없겠으나 여러 차례의 헌법개정과정에서 그 구성과 내용들이 무체계적으로 혼합되어있고 표현방식도 문제가 있어서 조문의 위치나 그 표현방식은 개정이 필요하다고 본다. 입법형식과 세계적인 입법례에 따라 전문, 국호, 주권, 국민, 영토, 통일, 국제질서 조항들은 총강에 남겨두고 나머지는 다른 부분으로 옮기는 것이 타당하다고 생각된다. 다만 헌법문은 문장을 다듬을 것을, 일본헌법을 그대로 옮긴 것 같아 우리말 표현이 어색한 국민 조항은 수정할 것을, 영토와 통일 조항은 유지할 것을 제안한다. 국제질서 조항은 동어반복적인 현을 수정하고, 정당해산제도는 폐지할 것을 제안한다. 공무원제도 조항은 행정부편으로 옮기고, 민족문화 조항은 기본권 장으로 옮기고 표현방식도 기본권 형태로 표현할 것을 제안한다. 헌법 총강 부분은 국가정체성이나 헌법의 기본원리들을 다루는 부분이고 헌법개정의 한계에 해당하는 부분이므로 개정에 신중을 기해야 할 뿐 아니라 충분한 연구검토가 필요한 부분임을 명심하여야 한다.

영문 초록

Is amendment of the General Provisions of the Constitution necessary? Contents of the General Provisions cannot be revised, because those provisions are basic principles of the Constitution. But it needs to revise location and way of expressions of the provisions, because repeated constitutional amendments made the General Provisions not systematic and their expressions problematic. In accordance with the legislative orders and world constitutional precedents, I suggest as follows; The preamble, the provisions of the name of country, sovereignty, people, territory, unification, and international order should be remain in the General Provisions part, and the other provisions move to the other parts of the Constitution. But the style and expressions of the Preamble should be modified. The expression of the people provision should be revised because it is not merely a copy of the Japanese Constitution but also does not match with the Korean style of expression. The provisions of territory and unification should be maintained. Tautological expressions of the international order provision should be modified, and the provision of dissolution of the political parties be abolished. The public officials provision should be moved to the part of the Excutive, the national culture provision be moved to the part of the Constitutional Rights and its expression be modified as constitutional rights. The General Provisions provides the national identity and the basic principles of the Constitution and they are the limit of constitutional amendment. Therefore, when we revise this part of the Constitutution we should be serious and study as enough as possible.
