국문 초록

우리나라는 1948년 처음으로 헌법이 제정하여 명문으로 기본권을 선언한 이래 60년 이상의 시간이 지났다. 과거 현행헌법 이전에는 헌법상 기본권이 선언되어 있음에도 불구하고 현실적으로 기본권은 충분히 보장되지 않았다. 현행헌법을 채택한 1987년의 제9차 개헌은 종래의 권위주의를 청산하여 민주적 정당성을 회복하기위한 개헌이었다. 현행헌법은 사법권의 독립을 강화하는 동시에 헌법재판소제도를 도입하여 헌법재판의 활성화를 도모하였고, 이에 따라 이제는 헌법이 과거 어느 때보다도 규범력을 가지게 되어 헌법상의 기본권보장은 현실화되었다. 그럼에도 불구하고 현행헌법이 채택된 이후 20년 이상의 시간이 지나면서 정치경제사회적인 환경이 많이 변화하였다. 헌법상 기본권규정이 내포하고 있는 이러한 문제점을 극복하고 국민의 기본권보장을 보다 강화하기 위한 방안으로서 우선 헌법해석으로 이를 보완하는 방안을 생각할 수 있다. 그러나 탄력적인 헌법해석으로 문제를 해결해 나가려는 노력은 오늘날의 기본권적 상황을 해결하기 위한 근본적인 대응책이 될 수는 없다. 여기서 개헌을 통해서 새로운 기본권영역을 규율할 필요가 있다는 입장이 기본권보장을 강화하기 위한 또 다른 하나의 방안으로 제시될 수 있다. 개헌을 전제로 기본권규정의 개정방향을 모색함에 있어서는 시대적 환경의 변화에 따른 기본권내용의 새로운 확충이 요구되고 있다. 이와 관련하여 기본권의 편제와 표제의 조정, 포괄적 기본권규정의 정비, 기본권의 주체와 효력 및 제한 등 기본권일반에 관한 규정의 개정, 평등권규정의 정비, 자유권 중 신체의 자유와 프라이버시권 및 정신적 자유권 규정의 조정, 사회권규정의 정비, 청구권적 기본권의 정비 등이 필요하다고 생각된다. 개헌이 필연적이라 한다면 이제라도 국민을 위한 기본권 보장의 강화, 실질화에 초점이 맞추어 모든 국민이 헌법의 살아있는 규범력을 향유할 수 있도록 배려하지 않으면 아니된다고 생각된다.

영문 초록

It has been over 60 years since our country established the constitution and declared fundamental rights for the first time in 1948. In past, before current constitution, despite the fundamental rights were declared in constitution, the fundamental rights were not guaranteed actually enough. In 1987 current constitution was adopted by the 9th amendment in order to liquidate hitherto authoritarianism and recover a democratic justifiability. The current constitution strengthened the independence of judicial power and introduced Constitutional Court system to actualize the fundamental rights guarantee of constitution. Already over 20 years passed after the current constitution adopted, and now the fundamental rights have been guaranteed actually enough. But meanwhile constitutional environments have been changed plentifully in political, economical and social fields. In order to solve the problems that fundamental right provision of the current constitution contains and strengthen the fundamental right guarantee of the citizen, we are able to consider the method of complements with constitutional interpretation first of all. But the effort to solve the problems with elastic constitutional interpretation cannot be a basic counter-measure of the fundamental rights guarantee situation of today. So it will be presented that constitutional amendment plan is necessary as another method to strengthen fundamental right guarantee and reflect new fundamental rights field. If we assume constitutional amendment to strengthen fundamental rights, it is demanded that new amendment has to contain contents of the fundamental rights following the change of periodic environment. First of all, the arrangement about the formation and the title of the fundamental rights has to be considered prudently, and the regulation of general provision about fundamental right has to be amended partly. Additionally, amendment of provision about equal protection principle and the rights of freedom contains phisical freedom, the privacy and mental freedom is demanded. Further, the arrangement of the regulation about social fundamental right and procedural right has to be accomplished partly. If constitutional amendment may be inevitable, I think the direction of amendment have to be focused on reinforcement of the fundamental right guarantee for the nation.
