학원 교습시간 제한 조례의 위헌성 검토

국문 초록

우리나라는 사교육이 너무 비대해지고 공교육이 그 기능을 제대로 하지 못한다는 목소리가 높고 이를 해결하는 것이 국가의 가장 큰 과제 가운데 하나로 여겨지고 있다 이에 따라 과거에는 . 과외를 금지하는 법률을 만들기도 하였으나 2000. 4. 27. 헌법재판소에 의하여 위헌결정이 났다.(헌재 98헌가16) 이러한 현실에 비추어 학교교육 이외에 학원교육을 통한 입시준비에 있어서 학원에 대하여 각종 규제가 따르고 있다. 학원의 교습시간에 대하여 규제를 하고 있으며, 학원의 수강료에 대하여도 다양한 형태의 규제가 있다. 과도한 사교육을 잠재우고 공교육을 정상화하기 위하여 학원에 대하여 다양한 규제를 하고 있는 것이다. 특히 현재 우리나라는 학원의 설립·운영 및 과외교습에 관한 법률과 각 시·도의 학원의 설립·운영 및 과외교습에 관한 조례에서 학교교과교습학원의 교습 시간을 제한하고 있는데, 동 법률의 위임을 받아 각 시도의 조례가 구체적인 교 습시간에 대하여 규정을 하고 있다. 전라북도를 제외한 각 시도는 조례를 통하여 학교교과 교습학원과 교습소의 교습시간을 05:00부터 22:00 또는 24:00까지로 제한을 하고 있는데, 이러한 교습시간의 제한은 과잉금지의 원칙에 위배되는 과도한 제한으로 학원운영자나 교습자의 직업의 자유를 침해할 소지가 많고 아동과 청소년의 인격의 자유로운 발현권을 침해하며, 부모의 자녀에 대한 교육권을 침해할 소지가 많다. 특히 교습시간의 제한을 통하여 사교육을 잠재우겠다는 것은 본말이 전도된 것이며, 허용된 교습시간 이후의 교습을 전면적으로 금지하는 것은 과잉금지의 원칙의 최소 침해성에 위배된다고 할 것이다. 또한 서울특별시나 부산광역시의 학원운영자나 교습자 혹은 학습자는 다른 시도에 비하여 차별을 받고 있다. 이러한 차별이 합리적 차별인지 아니면 평등권을 침해다. 각 시도 조례가 교습시간의 제한에 관하여 서로 다르게 규정하고 있다. 법률의 위임에 의하여 각 시도가 조례로써 정하도록 하는 취지는 각 지역의 사정에 적합하게 법령의 범위 안에서 조례로써 정하도록 하는 것인데, 교습시간 제한이 각 시도마다 다르게 규정될 사항은 아니라 할 것이다. 교육여건은 다르지만 학생들이 진학을 하는 데는 자신이 원하는 곳으로 자유로이 진학을 할 수 있도록 되어 있는 상황에서 각 시도가 조례로서 학원의 교습시간을 차별하는 것은 평등원칙에 위배된다. 특히 동일한 직업을 수행하는 학원 운영자나 교습자의 위치에서는 서울특별시나 부산광역시의 경우 다른 시도에 비하여 차별을 받는다고 할 수 있다.

영문 초록

Article 31(1) of the Constitution states 'All citizens have rights to receive equal education according to their merits', guaranteeing people's right to education. 'Rights to receive education' means the State's responsibility to prepare facilities and systems necessary for making such equal education possible and to formulate an affirmative policy of providing substantively equal education to the socially and economically weak. Item 6 of the same Article states that the basic matters about school education, lifetime education, and all other educational institutions, the management and finance thereof, and the status of teachers shall be specified by statute, specifying the State's power and responsibility in school education. The above provision delegated to the State the operation of school education, and thereby granted comprehensive regulatory power over schools and the responsibility for children's school education. The Act on the establishment and operation of private teaching institutes and extracurricular lessons restricts the learning children's and juvenile's right to free development of personality, parents' right to educate children, and the occupational freedom and the right to pursue happiness of the person who wishes to provide extracurricular lessons. The hagwon operation hours are currently controlled under municipal or provincial ordinances. The ban hagwon operation after 10 p.m. will do more harm than good. The ban will be difficult to enforce because of the sheer number of hagwon. Police crackdowns will meet resistance from both hagwon owners and parents. In all likelihood, hagwon will find ways to continue classes after 10 p.m. The ban hagwon operation after 10 p.m. violates the principle of proportionality because it is not the least restrictive means and does not balance the interests, thereby excessively and unconstitutionally restricts people's rights to educate children, to develop personality freely, and to choose occupations.
